Ive been in ireland 6 months. Looking to move back in 6 months after wife gives birth.

I was wondering once we return to uk what is the timeframe we have to apply for uk residence card using surinder.

Thats ofcourse if its mandatory.

Almost 5 months In Ireland, waiting for our EU1 response but still thinking how long after we better move to UK because the Directive doesn't say anything about the period that we must exercise our treaty rights in another member state so any advice about this please..

U can apply immediately u go back to the UK as long as you have satisfied the centre of life test. My advise is to get a family permit before you move back, it's not compulsory but it makes ur case look good

Hi,

Just wondering whether documents will be enough when we apply for eea2. We have been living in ireland 9 months and working 8 months when we return to uk.

Marriage certificate
Passports

Employment contract
Payslips for 8 months
P60

Tenancy agreement
Prtb letter
Electric bill
Waste bin bill
Phone bill

Yeah it is sufficient for the EEA2, also you can attach gnib card and bank statements to prove your legal residence in Ireland but it is not compulsory, it will make your application stronger though. by the way have you got your family permit or code 1A?

No still in ireland waiting for gnib card since we live outside dublin.

So no need to provide bank statements in regards to employment/residence.

yeah you have to wait 2 weeks to get your gnib card if you live outside of Dublin and why you don't wish to provide your bank statement? it will speed up your process no!?

I never heard bank statements are compulsory for the EEA2, it will make your case stronger if you provide them but some people provided it and been asked about their salary didn't come to their accounts so it would be better not provide them if we don't get our salary to that account, otherwise it is good for us.

Alpha you are better of providing bank statement, it helps with centre of life cos u had a job in the eu country u moved to, the chances are your salary was paid into the acount.

When u go thru the explanatory note of the form it states examples of document required. So u do need the ur bank statement of ur account in the eu country u exercised your treaty

I get paid by cheque/cash.

Never deposited all the time since i need money on rent days etc.

Really surprises me since i was never asked bank statement by irish authorities.

My wife has received her 5 year card in ireland.

Been here for 9 months and not spent a single day outside ireland.

Really upsetting since i have put a lot of effort into it only to find out i could be rejected.

hi alpha,
I completely understand where you are coming from but it is a bit unrealistic to say you lived in a country for 9 months without using a bank. how else will proof centre of life was moved. I agree that you could have been paid by cheque, but again that raises a lot of question because majority of employers pay into account and the ones that pay by cheque give you cheques that have to be paid into a bank account.

am not disputing your story I am just expressing an opinion from the case workers point of view. even if you never used your bank for salary, did u at least open an account in Ireland. if yes regardless of if your salary went into that account or not just print the statement. that was why I referred you to the guidance form for the eea2 its pretty clear on list of supporting documents to satisfy the basic requirement of ss route.

if you have other means of satisfying COL such as evidence of integration i.e did u join a local club, library membership, church/mosque membership, store membership etc that might help ur case

I have opened a bank account a couple of weeks after coming here.

I have thrown money into account but never considered it should match payslips.

I completely agree with adedayoh A forum member only used a month statement for the EA2 and it was successful so you can just give them one but unlikely if you said you been paid cheque the case worker might look at your statement if the cheques has been credited in your account so what if you say you paid cash in hand?
