Previous taxes

Hi Members,

One of my friend will be applying for ILR soon.
He got Tier 1 visa in April-2011 using limited company ABC,
And then he got Extension of Tier 1 visa in April-2013 using limited company XYZ.

He got wrong advice as there is no link between UKBA and HMRC and he dissolved both the limited company without paying any tax.

And now the scenario has changed UKBA is looking for all the previous tax history and he is happy to pay all the taxes.

1- Just wondering can he pay to HMRC in instalments or he as to pay full before applying.
2- what are the chance of getting ILR with new limited company?

He need to get a professional accountant to sort out his taxes.

UKBA is not discriminating the candidates who applying under limited company for ILR. Its all about earnings of an individual.

Your friend should be fine as long as he has a payment arrangement with HMRC, however getiing this sorted might take some time.. so ask him to get an accountant who can write to HMRC explaining everything in detail.

Yes, he will have to get a good accountant to sort out all the tax issues.

Sorry, I am asking same question again.
If he pays taxes in instalment and at the time of ILR application few instalments will be pending.
Will it be ok with UKBA? Is UKBA looking for full paid taxes or they will be happy if payment is still continuing after ILR application.

if your friend has closed the company then he cant pay Corporation tax until he get his company re-open from the court this is quite lengthy and complex process which will cost him roughly 3k to open these two companies.

but he can still do his self assessment which HO only looking now so far they haven't start looking company accounts yet.

now bad news is if your friend was never registered for SA with HMRC and if there is no tax liability raise then HMRC wont do any update for tax year 2010/11
for 2012/13 they would do it in both cases

suggestion is in both year make sure you create some liability pay from your pocket you may be fine heavily for this but they will update then by making special arrangments specially 10/11

There's still the question of deception. It would be churlish to expect the authorities to look favourably on those who have attempted to deceive them.
