Bri2015 : you mentioned in your previous post in another thread that you got US visa and flying to US soon and you are not fighting with UKBA. Just asking as it has been quite few months that ur ILR was rejected. r u still in UK? what steps did you take after refusal of your ILR?

HMRC and UKBA are 2 different institutes. Most people are scred of hmrc as well as they are from ukba. But hmrc will always try to help you. Whenever I spoke to them they always try every possibility to help you out. They can't change records beyond 4 years but the can issue you letters whatever you want
Don't beg to hmrc. It is your rigjt and ask for your right.

thestral01 - glad to hear the nightmare is over
Two question:
they refused your original application claiming deception. But you were able to stay and fight.
Did they mention your old leave in any way? Obviously they didn't cancel it. But did they say anything like we won't let you back in on next entry or anything?
Also did your solicitor mention anything about having this on your record effecting citizenship?

Thanks trbvm. On my initial refusal, HOme office didnt curtail my Visa.
I am not sure about the impact of this (refusal) on citizenship, havent checked with solicitor yet.

Yes Wasi36 and thats exactly what happened in my case, HMRC tried to help their best once they knew about my ILR application date.
my 10-11 return couldnt be updated in their system as it was beyond the deadline - so all they did is took the last page from my 10-11 SATR where my accountant had put up the income/tax calculation and printed that off in HMRC letterhead. They initially said they would post this letter , but as there wasnt enough time, they asked me to go to their office and collect this letter from their official in person. Quite an unbelievable story for people who have never tried well enough !

Hi thestral01,
I have a 100% similar case. My ILR was also refused on the same basis. My 2011/12 and 2012/13 self assessments were not filed as i got UTR after that and no tax was due so accountant didnt filed them. I filed the returns 1 day after my initial application upon realization and got the SA302s but my application was refused.
I have applied for admin review via a solicitor but i dont like him at all.
I would be grateful if you can share the contact details of solicitor that you mentioned in your post ( based in Covent Garden, London ) ?
Eagerly awaiting your reply
Rgds

Hi thestral01,
Congrats for your ILR approval.
I have a small question, if anyone due to pay tax of their dividends for year 10-11, will HMRC take the tax and update their profile for 10-11 year?

I sent paper SATR for 2010-11 in late september and followed up with HMRC almost on a daily basis. Originally they had said the turn around would be December though.
Anyone knows a good solicitor with proven experience in Judicial review/pre action protocol type cases ?
@ thestral01 how can i contact you?

As we have no tax specialists on the forum, this thread has run its course. Any members looking for help on tax discrepancy/deception issues should search for a tax forum or seek help from tax professional.
This forum is for immigration issues only.

Please don't send me PMs asking for immigration advice on posts that are on the open forum. If I haven't responded there, it's because I don't have the answer. I'm a moderator, not a legal professional.

You having massive doubts doesnt change my truth a shred !
I didnt owe any tax for 10-11 and HMRC did speak to me and when I explained them that they have to somehow update it in their system, showing my dividends for the year given my ILR date was on 16th, it was transferred to a senior member of staff. He spoke to me, called me back as well on my number on Monday keeping me posted on progress. I tried my best and requested them almost every other day, explaining the cascading effect this seemingly unimportant task for HMRC would have on my future in the country. And everytime I spoke to HMRC, they understood my situation and have given me all possible help.
When HMRC realised they cant update it on their system, he did advise me of an alternate route. He asked his colleague in Ealing HMRC office to get a manual calculation of my 10-11 tax returns prepared on HMRC letterhead and I went and met his colleague who handed over it to me personally. He also gave his mobile number just in case Home office wanted to speak. He also added a note on their system saying I didnt owe any tax for 10-11. He went on to add that he would be at Croydon HMRC office on 16th afternoon just in case I wanted to meet him.
Yes all this would sound unbelievable not to you, but most of you , but the fact is this is the truth and I have experienced it myself, still not believing all this happened. ANybody doubting it is free to do so, I am not here to prove a point rather just share my experience.
Its upto you to believe my words or ignore it, I just wanted to share my experience. And to your question I dont know the designation of the people I spoke to, they were from the NES team is all I know of.
Hi Thelstra,
I am in the same situation as you are. Can u send a pm? thanks
