FLR(M) Rejected appeal still not heard

Post by razazel » Mon Dec 28, 2015 10:09 am

Hello
I applied to FLRM spouse visa in September 2014 while i was a on student visa tier 4. They rejected on the bases that my spouse only started the job 4 months prior to application.
I appealed this decision within 28days and,
got a hearing date in June 2015. On the day we went and (due to unavailability of judge it was reschedule)
i was given a next hearing date in March 2016.

Now its end of December and my wife is expecting in Jan 2016. And she is unable to work and her pay will fall down if she goes on maternity leave.

i wrote a letter to UKBA they rejected saying Reconsideration Rejected by stating
topics
1. Reason for rejection
2. Consequence of Illegal stay
3. If you have further reason to stay in UK
This section ask me to submit a reason to stay in uk within 14days of receipt of this letter.

As mentioned above my hearing is due in March 2016. My questions
1. My hearing will be invalid if ignore this letter ?
2. If i write back to them what should i write ?
3. Will they come to remove me before the Hearing date ?

Thank you please kindly guide me

The option is to either withdraw the appeal and reapply or wait till the baby is born and you will qualify under the private and family life route on the basis of your child, and you will not need to meet the financial requirement, and you will qualify under the 10 years route.

If the OP applied for FLR(M), the sponsor is either British or has ILR.

I think this OPs statement is self explanatory!

My wife the sponsor is in full time employment since June 2014 earning 20k+ gross salary. I was previously on student visa tier 4 No work allowed and no recourse to public funds

If i withdraw my appeal or do fresh application, wouldn't i be considered overstay since 30th September 2014. according to 1st October 2012 law.

What is OP ?

and what do i do with the letter in hand which i have to reply with in 14days reconsideration rejection letter .

Thank you for your review

It may be fine if done properly, otherwise you will have to rely on the birth of your child.

I think if the madam is going to be taking time of Work, it helps if you get your residency sooner, so you can look after the family whiles she is away from work.
