ILR - Previous earnings question

Post by ozmanos » Mon Jan 04, 2016 11:05 am

Hi,

I have an urgent question regarding my salary/previous earnings and the points to claim for it.

Here are my details:
Received Tier 1 visa: 10/02/2011
Extended Tier 1 visa: 22/02/2013
Tier 1 visa valid till: 22/02/2016
Applying for ILR (by appointment): 20/01/2016 (As I entered scheme on 10/02/2015)

The 15 months I have to show 12 months previous earnings from would be Nov 2014 - Jan 2016

I was working in a permanent role Nov 2014 - Jun 2015, and my earnings during this time give me enough points for ILR. I was searching for job during Jul 2015, and then started contract work (Limited Company) from Aug 2015 - Jan 2016

Considering the following from immigration law, I have a question below:
- An applicant does not have to be in continuous or full-time employment during the 12 months being assessed.
- An applicant may claim for a period of earnings of less than 12 months if they have earned sufficient funds to claim the necessary points.

Question:
- Is it fine if I use the the first 12 months (Nov 2014 - Oct 2015), and only provide salary details for when I was working in permanent role (Nov2014 - Jun 2015) for 8 months, as that gives me enough points, or do I need to provide salary details for when I started working as a contractor as well (so the entire 12 months)?
- Does HO need to check my current state of earnings as well or are they only interested in the months i'm claiming points for?

I would really appreciate if someone could clarify the above for me so I can prepare my application documents accordingly.

Regards,
Ozmanos

Yes that should be fine.

The maximum is 12 months, there is no minimum e.g. you can earn 35K from one single contract in 1 month so you qualified for the points.

That's great, thanks for quick reply.

Regarding my second question:
- Does HO need to check my current state of earnings as well or are they only interested in the months i'm claiming points for?

The reason I asked this is because I will not be bothering in providing any documentation (payslips/tax documents/SAs) regarding my current contract role. I'm assuming that HO won't be interested in going through them? Or should I have them with me as well when I go for appointment? It's just extra paper work I wanted to avoid if not necessary.

Thanks sweetfrost01, going with your example, do I then only submit salary documents (payslips, bank statements, etc.) for that 1 month or do I still need to provide documents for the entire 12 month period? I just want to avoid any extra paper work if it is not necessary.

Many Thanks,

Continuous Period - Unpaid Leave

Post by ozmanos » Tue Jan 05, 2016 1:47 pm

Hi,

Here are my details:
Received Tier 1 visa: 10/02/2011
Extended Tier 1 visa: 22/02/2013
Tier 1 visa valid till: 22/02/2016

Applying for ILR (by appointment): 20/01/2016 (As I entered scheme on 10/02/2015)

I've got an urgent question, in my last 5 years, I've taken 2 weeks of unpaid holidays. This was because I had already used up all my allowed balance and I after I got married I planned my honeymoon using an extra 2 weeks. My question is, would that break my continuous period and re-set the clock?

I would appreciate if someone could help me with this in light of immigration rules.

Regards,
Ozmanos
