Tier 2 Dependent Visa

Hi Gurus,

I have a peculiar situation here. I am an Indian national presently in Canada. I have secured a job with a premium rated sponsor. My RLMT will be over my mid Jan which means it can go for CoS in Feb cycle. I can apply my visa in Feb mid if everything goes as planned.

Now my wife and kid are in India. Please advise if they can apply visa at the same time as mine, myself in Canada and themselves in India. If this is not possible then what is the earliest they can apply visa for UK. Is it mandatory for main applicant to travel to UK before dependents can apply for EC.

They can apply after your visa has been approved. How long have you lived apart? You will need to prove subsisting marriage.

Thanks for your prompt reply. We have been living together mostly a couple of months on off. We have been married for 5 years and have a child too. Even earlier both myself and my wife have been given tier 2 ict dependent visa on each other tier 2 ict migrant visas. Do you think still the subsisting marriage proof is required?

What is your immigration status in Canada? If a "visitor" then you cannot apply from Canada.

As I mentioned, had you been there as a visitor it wouldn't have been possible. Since your initial post didn't mention anything about your status in Canada, I thought it wise to forewarn you.

But you have PR, so nothing to worry.
