Any Chance for my ILR ?

Post by OyeLuckyOye » Wed Jan 06, 2016 9:45 am

Hello

I know rules are very very strict to go for ILR, but since I am in UK for more than a year now.. just trying to explore possibilities... here is my case history.

I entered in UK in Sept 2014 on ICT Tier 2 Long Term (3 years) and need to explore the following options:

1) Is there any way that i can switch to Tier 2 (General)? Due to cooling off constraint, to apply for Tier 2 General, one has to be out of UK for 12 months.

2) Planning to choose Tier 2 General as due to rules change, i cannot apply for ILR while on Tier 2 ICT so only option left is Tier 2 General?

3) Any other ways i could apply for Tier 2 (General) to eventually reach to ILR?

Appreciate any help, guidance.
Thanks,
Lucky

Hi sushdmehta

Apologies.. I should have mentioned that I am posting this request on behalf of my friend (Lucky). I have just posted his query as he send me in mail.

Could you please help me understand his case, if he can move to Tier-2-Gen ?
I know he has to go back to India and not sure if he need to server any cooking period. :)

Qualifying period for ILR would include his time spend on current ICT + remaining on Tier-2-Gen ?

Thanks

1. He need to serve cool-off period.

2. The duration in ICT visa will not be counted.

Thanks Moonlight for your response.

Regarding cool-off period :-
If he will go back to India.. and resign from current company and moved to Tier-2-Gen, does this cool-off period still be applicable to him ?

Just trying to understand how he can be waived off with this cooling period.

Kind Regards,
Vikas
