dear manci,

just to clarify:

I initially came under Work-permit (intra-company) in 2008. I left the UK on 26 of November 2009 in order to apply for extension. We were waiting for the sponsorship license for 4.5 months (!) and therefore I was not able to put my application before 5th of April 2010 since I only got a COS on 4th of May 2010. Otherwise my case would be exactly the case of curiouscrab - I would put an application before 5th of April - it would get rejected (without COS number) and I would put it again with the valid COS number... The only difference would be that I had spent a year in the category but his application was a new entry...

what were the start and end dates of your wp?

Hi all...

I am in uk with tier 2 ict...currently resided in uk and no break or what so ever...

26th march 2011-- ict est staff..after that it got extended..

28 th march 2014 - ict long term...2 year validity..going to complete 5 years om march 2015

On march 28 th 2016, am i eligible for plr or not...

I have applied my first ict visa app in the month of march 10 th 2011...That was 2011 Rule i place...


I really did not know there were many immigration rules changed left and right...

And also any clues on ict to tier 2 general....

unfortunately you are not eligible for ILR because your initial T2 ICT visa was under the rules after 5 April 2010

I really did not know there were many immigration rules changed left and right...

And also any clues on ict to tier 2 general....
you are eligible to switch to T2G if you find a new sponsor and after 5 years on T2G you will be eligible for ILR

Hi Manci,

If i move to tier 2 gen visa new sponser and get dependant visa for my family do i need to apply for visa process for dependant every time when i change sponcers...

Dear Manci,

i have first entered Uk on dec 2007 with work permit entry clearance (in relation to ICT)valid from Sept 2007 till Sept 2011. During my 6 months maternity leave, I was outside of UK and as my work permit was coming to an end (5 Sept 2011) my sponsor provided all necessary documentation and I was granted tier 2 (ICT long term) established staff entry clearance starting from 6 Sept 2011 valid till oct 2014.I have entered UK on Sept 6th. 2011.
During 2013, I've changed role and SOC and have received BRP valid till Oct 2015 (Sponsor will provide all documents for my 1 year T2 ICT extension till Sept 2016). During 2013. I have also applied for ILR but my application have been rejected due to more then 180 days absence from UK during maternity leave.
I have been working for the same employer since 2007. and have been fully paid during my maternity leave. Can you please advise will I be eligible for ILR in first 6 months 2016. as in period May 2011 (WP holder) till May 2016 (ICT migrant) I will have 5 years of continuous period in UK with less then 180 days/a absences. Not sure if you are still replying to this thread or not, but I will post my query anyway. Honestly, I was very excited to see this post because initially you started off by stating that
if your 2010 entry clearance stamp is "VISA TIER 2 (INT COM TRAN) MIGRANT" followed by the CoS number then it was granted under the pre 6 April 2010 rules and you will be eligible for ILR after 5 years.

You also went on to state a little later that
if entry clearance had been granted under the rules in force 06/04/2010 - 05/04/2011 the visa stamp would have been: TIER2(ICT)ESTABLISHED STAFF followed by the CoS number
.

However, as the conversation progressed (though some others like Susan0x supported that statement), a lot of focus was given to the visa application date. :( So am now wondering why is the application date so important and isn't just the visa category enough to suggest whether or not my visa was granted in the pre/post 06 Apr 2010 rule? :?: If the answer to this question is NO then there seems to be a grey area for people like me who have a VISA TIER 2 (INT COM TRAN) MIGRANT stamp but have applied either on 06 Apr 2010 or a few days after.

Anyway, after a LOT :roll: of digging around for old emails, I found the following details of my initial application:
First initial CoS issued on: 31-Mar-2010
First initial Biometrics done at UK Consulate in India: 14-Apr-2010 (I am not 100% sure but I believe this was the day I paid the fees for my visa application as well).
First initial CoS start date: 15-Apr-2010
First initial Visa start date: 28-Apr-2010
First initial Visa end date: 15-May-2012
This was followed by couple of 2-year extensions under the visa category T2ICT LONG TERM LEAVE TO REMAIN (Remarks: Restricted Work) followed by CoS number.

My current visa is valid until Apr-2016 and am currently in the UK. If I satisfy all other requirements, can I get ILR via the 5-year route?
Please say YES! :mrgreen: This is probably the only second most important time (after my marriage proposal to my wife) where I have really really REALLY REALLY wanted the answer to my question to be YES! :lol:

@curiouscrab and @Smart.Dixit - you both have very similar cases to mine. Did you file for ILR and if yes, what was the outcome? Please do reply guys, am desperate for some guidance.

@curiouscrab, @Smart.Dixit and CloseCallT2ICTilr: Not sure you guys are still active on this forum. Did you ever apply ILR? I have heard that UKBA has granted ILR to people who had visa application date little (few days/weeks) after 6-Apr-2010 deadline . Maybe there are some internal grace period? Any thoughts / updates from you guys?
