Tier 2 ICT - ILR Possible?

Post by Rahulv » Thu Jan 07, 2016 5:58 am

Hi All,

I am new to this forum and would appreciate some help from experts.

1st COS Dates: mid - late March 2010, exact date will be confirmed
VISA fee Acceptance date 6th April 2010.
VISA start date 14 April 2010.
Granted for 1 year and extended since then until 2016. Next extension from company is due and already have COS till April 2016 end.

VISA Renewed : until 2016.

I read lot of documents, and understand that I can extend my current leave to remain until whenever, is my understanding correct.

Also, can I apply ILR provided i fulfil continuous stay in uk.

Thnks a lot for your help.

Thanks sushad, my doubt is on the date visa fee is accepted. Does this changes the condition of rules changes from 6th April 2010.

What rules is a migrant subject to depends on the "date of the application".
Date of application is defined in 30 (entry clerance) and 34G (leave to remain).

So, in your case, date of application = date of visa fee acceptance = 06-Apr-2010.
Hence rules in force on that day (06-Apr-2010) apply to you.

Thanks Sushd, for your replies.

Does it now means I can not apply for ILR. ?

Don't the FAQs answer that question for you?

FAQs does not tells about the application accepted 'on' 6th April. It tells application which are accepted after 6th April.

Regards, and thanks for the help.

Q1 - Missed reading the word "before"?
Q2 - Missed reading the words "on or after"?

Simple plain English!!
