Tier-2 ICT - Extension time limit

Hi Manci,

I have a similar queries.

My visa was issued on 1 Oct 2010 under category - 'Tier 2 (ICT) - Established staff'. Due to this visa category ceased to exist, it was extended in September 2012 under category 'Tier 2 (ICT) - Long term'. There after it was extended twice (Sept 2013 and December 2015) under same category.

Queries
1. As there was change in category, will it still be treated under T2ICT Established Staff?
2. Can we switch to T2 General within UK?
3. Is there any specific point to be known/considered while switching Visa?

1. As long as our "initial" visa was issued in Oct-2010 and you have continuously extended your visa from within UK, your visa will be considered granted under the rules in place before Apr-2011. Hence, no 5 year limit will be applicable in your case.

2. Yes, you can switch provided you find a sponsor.

3. Might be worthwhile to read through the T2 guidance document for all the details.

My CoS for T2 ICT ES was submitted on 25- Mar-2011
Application Fees was paid on 30-Mar-2011
Visa was stamped as valid from 8-Apr-2011 (as T2 ICT ES)
Visa was stamped as valid until 8-Apr-2013
I entered UK on 24-Apr-2011
First visa extension for 1 year to T2 ICT LTS on 25-Mar-2013
Second visa extension for 2 years on 23-Mar-2014

1. Entry Clearance will be calculated from which date? (Date of application, Date visa stamped or Date I entered UK)
2. Does 5 year stay limit in UK apply to my case?
3. If I switch to T2 G (if this is still applicable to me) is 6 years limit applies to me starting from 2011?

No.

You can change to T2 General. However, you will have to serve a cool-off period of 12 months outside UK before you can apply for T2 General. Or your salary should be more than 153,500K to avoid the cool-off period.

a) Is there any other way I can apply for settlement w/o cool off period and salary more than 153,500K? No there is no way, unless you switch to spouse of British Citizen or person with ILR, which can be done in country. If you have a dependent spouse, your spouse could apply from home country for Tier 2 G if they qualify and you can switch in country to Tier 2 G dependent.

b) After 12 months of cool off period if I get T2 visa how many years I have to wait again to be eligible for Settlement? 5 years on Tier 2 General providing you meet all the requirements.
