Tier2 ICT -ILR Eligibility

Post by Jazzuk » Sun Jan 10, 2016 11:26 pm

Hi Gurus,
I initially traveled to UK in May 2011 on Tier2 ICT short term staff migrant visa and left to India in April 2012 on visa expiry. I travelled back to UK in July 2012 on Tier 2 ICT Long term staff migrant visa and currently continuing to live in UK since then.
I will be completing 5 years of my stay in UK in May 2016 since my first visit to UK on Tier 2 ICT.
At any point of time, I've never lived out of UK for more than 3 months max. I.e. between Short term & long term visa.

Please could you let me know if I would be eligible to apply for ILR this year? This will help me in planning my future stay in UK.
I've read a number of blogs but none of them clearly mention about the eligibility?
Any help will be highly appreciated!

Thanks in advance.
Jazz.

No, you don't qualify for ILR as Tier 2 ICT issued after 6th April 2010 no longer leads to ILR.

Hi ,
What happens to those who got Tier2 ICT between April 2010 to April 2011, is there any specific guidance for them on when they can apply for ILR.

Let put it in another way. You need to be in Uk for more than 5 continuous years in order to be eligible for ILR. Post 6th april, 2010, all T2 ICT migrant will be issued visa for max. duration of 5 years ( 10 years if your salary is in >150K figure ) after which they must go back and serve 1 year cooling off period before coming back to UK. This is to ensure that ICT migrant never gets eligible for ILR

People who got Tier 2 ICT between april 2010 to april 2010, there is no restriction of 5 yrs. Visa can be extended beyond 5 years, after 10 yrs you can apply for long term residency.
