New Entrant or experienced salary

Post by mctown » Wed Jan 06, 2016 10:38 am

Hi

I am on tier 2 since Feb 2013 and I am currently on SOC Code 1132 and being paid £32000/year

Now my extension is due next month and I am bit confused, can I extend my tier 2 using the same SOC code with same salary or I should be paid experienced salary which is £47900 according to latest version of SOC codes.

I would really appreciate if someone can guide me .

Thanks

It clearly states in the Tier 2 policy document that the skill levels don't apply if you are applying for a extension (but the policy document is for applications after Nov'15).

See page 22, point 78.

I hope I don't have any issue as you do. Making me nervous now :(

Thanks

Hi Vish,

I'm now in the process of administrative review. Fingers crossed. Will let you know the result later.
I think you will not have the problem, as you have the positive reply from the Home Office.

Best,
Meng

Hi

I spoke to UKBA couple of days ago and I was told that you can only be in New entrant category for maximum 3 years and as you are applying for extension you should be treated as Experienced that's why your salary should be increased ,but the policy docs made me even more concerned

according to page 5th of this docs , it also says that even if you are applying for extension you Salary level should be increased. https://www.gov.uk/government/uploads/s ... 4_V0_6.pdf

Please help

Thanks

Hi mctown
What is your working hours in a week? £47900 is for 39 hr per week. I have extended my visa on july 2015. i was also on 1132 but during extension my company use 3545 soc without RMLT. the company said 1132 n 3545 are same categories. so as I think your also can use 3545 code which has 32000 with 39 hr per week.

Hi Saima123

I work 37.5 hours per week .
does it mean salary has to be pro rated accordingly if I use same SOC Code (1132)
is there any ref available which confirms that SOC Code can be changed at the time of extension without RMLT.

Thanks

Hi
yes the salary is pro rated basis. my working hour is 32 per week 26900 in 3545 code. I used 3545 doc without any RMLT. you can find this in conversion table. https://www.gov.uk/government/uploads/s ... l_2015.pdf
M sure 100% sure there is no need of RMLT. and you can use your same salary n working hr just changed soc code.
thanks
