UK born child with leave to remain - Parents on ILR

Post by dkmca80 » Fri Jan 15, 2016 11:14 am

Guys,
Need small help if anyone has travelled or planning to travel recently. I have one question-

1. I, wife son both got Tier 1 Extn in 2013 and valid till Dec 2016. Child was borh in 2013 and after that we all applied for Tier1 extn.
2. I and wife got ILR in April 2015 and didnt include son in the ILR application as he has tier 1 dependent visa valid til Dec 2016.

Now we are planning to travel to India in Feb 2016 and coming back in April and then all will apply for Naturalisation is one go as we are completing 1 yr in April 2016 after ILR in April 2015.

Can I my son travel to and fro India on my tier 1 dependent valid til Dec 2016 though both parents have ILR now.. Pls suggest.

No, but many forum members have done and do this. If you/spouse got ILR based on Tier 1, the childs existing leave/visa will continue and he can travel as long as he returns before it expires.

It would be different advice if you got ILR based on 10 years long residence.
