No visa, but UK-issued EEA Residence Card

Post by a.s.b.o » Fri Jan 15, 2016 6:31 pm

Hello guys, there is a bit of uncertainty here and we need some of your help.

My relative has a EEA RC issued by UK (article 10, a dependent direct relative). She will fly to Dublin where I meet her and we drive to Belfast. I was not able to find a link to a Timatic tool to verify this, but I do have the answer from INIS that she does not need a visa to enter Ireland.

----
Thank you for your email of 03/12/2015.

Non-nationals who are family members of a European Union citizen and
holders of a document called “Residence card of a family member of a Union
citizen” as referred to in Article 10 of Directive 2004/38/EC of the
European Parliament and of the Council of 29 April 2004, are not subject to
an Irish visa requirement.

Please contact the issuing authority for advice/guidance as to whether the
document/card you have comes within the definition of the Directive, as
implemented by that particular Member State.

[The Immigration Act 2004 (Visas) Order (S.I. No. 473 of 2014), Section 3
(c) states that non-nationals who are family members of a Union citizen and
holders of a document called 'residence card of a family member of a Union
citizen', as referred to in Article 10 of Directive 2004/38/EC of the
European Parliament and of the Council of 29 April 2004, are not subject to
an Irish visa requirement.

The quoted text is directly transcribed from the Directive itself. The
reason we refer you to the issuing authority is because there is no
uniformity in the wording of residence cards pertaining to the Directive
across member states. Therefore, it is for the issuing authority of each
member state to determine whether or not it falls under the terms of the
aforementioned Directive.]

Kind regards,

Now, this is clear to us. However, I am concerned that Ryanair checkin desk will insist on her having an Irish visa. My mother is very distressed right now and I did try to illicit the answer from Ryanair but it seems that it is a hard task. Can you please share your experience / suggest sources to ensure that no boarding is denied due to not having a visa.

Thank you very much

This may help reassure you, see:

Simply furnish mother with a printout of the Directive (& that INIS email) and tell her to walk tall.

Good luck.

Thank you very much! The point is pretty clear, and I have less concerns for her ability to clear immigration than for the ability to convince Ryanair visa checking desk. My experiences of communicating with them to seek clarification has be abysmal; I am confident that a lay person doing this work at Vilnius airport should be more savvy than his/her colleagues on RyanAir chat service.
