Hi guys,
I once again need your expert advice. My employer hasn't paid me my maternity pay since 5 months! He promises me he is going to pay but never does.
I started my maternity leave from 15th May and got paid till july.
I am on tier 2 dependent visa working for a small company since 2 years. There have been payment issues in the past, but don't the employers get to claim the maternity pay to pay the employee?
I have submitted the MATB1 form as well as an official letter.
I have been chasing my boss since 4 months now and I am tired.
What are my options? Should I report to HMRC? Or see a solicitor?
I want to quit my job as well but don't know if I should wait to get paid...so confused! :?
Need your suggestions please.

I suggest you make an appointment to discuss this at your local Citizens Advice Bureau (CAB). The advise would be free. In the meantime, read through the information in this link and in particular, section 3.1

Hi Guys,

Just to update the latest information regarding this, I contacted the HMRC.
They got in touch with my employer and followed him up on the payment.
They also calculated the total amount which I am liable to get.
HMRC pays you all the amount from the date of your company's dissolution.
Regarding the payment previous to dissolution of the company, HMRC pays that too after chasing the company for 1 month with no result.
If the company is not in dissolution and still running good, the HMRC will chase your employer to pay you, and eventually end up paying you themselves if your employer doesn't.
So its a win win for those who have not been paid their maternity pay. Please get in touch with the HMRC asap!
