EEA PR - Question 9.16

Does anyone if answering Yes to the below question will affect my application in any way?

9.16 If, at any point during the accession period, you/your sponsor worked without holding one of the documents listed in the table above, why was this?

Just to clarify, I have a 5 year period of working without the WRS before I completed my 12 months WRS period.

What were your dates related to WRS?
There is an exemption if worked started before 2004 (or you were a dual national);
also WRS terminated in 2011

my question is about any work history prior to having a full 12 month WRS with one employer.
i have a long, 5year, period before my qualifying period that i worked without having a WRS cert. will this be frowned upon when applying for my PR?

I understood the question.
- if your dates happen to fall outside the range it won't matter - so do they?

And, thinking outside the box...
as per linked article, you do not need to apply on the latest official form;
- you can apply by letter or see if there is an earlier version of the form (with different questions) available in the Gov UK archive website.

that's not a bad idea to use a different form or a letter.

regarding my dates:
18.06.2004 - 22.07.2005 - one employer, WRS application on 29. 07. 2005 - just a few days after the 30 day period (so angry!) WRS issued on 13.09.2005
then from 25.07.2005 till 08.09.2010 worked without re-registering for a number of employers (I misinterpreted the rules thinking I have completed the 12months)
26.10.2010 an agency made a registration on my behalf and I worked for them for 3 years.

so I am applying on the basis of the period starting 26.10.2010 but I am worried if the 5 years prior will mess things up.

As you started work after April 2004 you are correct you were supposed to register for WRS.

Unfortunately, by not re-registering when you changed jobs means you didn't complete 12 months under the scheme, & so your PR clock may not have started until WRS was terminated (April 2011).
That means you may not have acquired PR yet - until April/May 2016.

So even avoiding the question by using another version of the form or applying by letter may not help you.

If you had registered late and then stayed registered continuously you might have been ok.

But unfortunately, due to the earlier registration & then not re-registering with subsequent employers, you/your employer rendered your registration null & void.

My understanding is the time won't be counted as legal work.
So your PR clock will only have been started when WRS ended (2011).

gammavega can you please advise how is your application process going?

noajthan - do you think HO will just ignore the period which wasn't covered by WRS when application is posted to them after April 2016? How to answer this question 9.16?
