MN1 Form Queries

Post by hood » Wed Jan 27, 2016 4:18 pm

Hello

I have had great help from this forum. Have posted before, but as it’s been a while need some clarifications please.

I got ILR last year and both my kids are born in UK, but they too got their ILR with me last year as we had to travel due to a family commitment.

1. As I now have some money I would want to apply for MN1 registration (under
section 1 (3)) for my 2 kids? Am I correct to say that I need to use MN1 to do this,
and need to fill in 2 separate forms for both my kids?

2. On MN1 form, I just saw that on question 1.3 there’s a question relating to if the
child ever had indefinite leave to remain to state when it was granted? Should I say
yes to this or just ignore? Similarly under section(6) Question 6.1 – have you ever
been issued with a BRP with previous application and then a request to submit the
BRP card as part of the application.

3. Can I say yes to all these questions and then submit the BRP Card, would it make
sense to write a cover letter with the application to explain while my 2 kids has to
apply for ILR in the first place

Your help with the above 2 queries would be much appreciated.

Thanks

1) Yes.
2 forms; 2 fees.

2) Say no (or skip) if minors do not have ILR.
ILR is not required for minors applying under Section 1(3) of BNA.

Edit: I just noticed you state children have ILR. In that case, suggest enter relevant date.

3) A brief note may help.

1. Yes, section 1(3) if UK born. Yes, MN1 is the form and yes, two forms - each applicant has to complete a form.

2. Yes, if the child has ILR then you can complete the details. If you use NCS to submit, they will copy the BRP and give you the original back. It becomes invalid/cancelled once citizenship is approved anyway.

3. No explanation needed. It is your choice and HO don't really care why you paid £3000 for ILR for your kids. You should retain the BRPs (using NCS) in case you need to travel. MN1 applications can take many months sometimes.

Thanks all.

I do not intend to use NCS so I guess its a must for me to submit the BRP card with the application ?

Just something strange to add to the forum, a very close friend we both live in Edinburgh submitted his daughter application in November 20th and the application was returned on the 5th of January with a certificate - I can confirm this.

I am amazed people in September are still on waiting list.

Looks like sometimes HO do cherrypick applications

There have been some on here who have had their applications approved in under a month, yet some people have been waiting over 18 months. It seems they are processing the applications done through the NCS pilot project much faster at the moment.
