ILR/Settlement Visa cancelled - TOEIC

Post by Dodi khan » Tue Jan 26, 2016 9:49 pm

I am in uk 13 years, I have settlement visa since 2014.
two days ago I received from HO letter about my visa canceled, because when I was submitted new application in 2012,I used TOEIC test certificate, and my visa was granted.
Now they says that On the basis of the information provided to her by ETS, the SSHD is satisfied that your certificate was fraudulently obtained, but my certificate was genuine.

If anyone have any information about this issue, please sher or advice.

Thank you

If it's a letter revoking your ILR, it will say you have a right of appeal to the Tribunal.

If it's a letter declaring you a s.10 illegal entrant because of previous deception, you probably have an out-of-country right of appeal.

Without knowing what your letter actually says, it's not possible to say what next steps you should take

If the Human right claim is not certified , then they will have to grant in country appeal.

Not necessarily. It could be a s.10 decision, which is out-of-country right of appeal only.

That us not correct.

Under the new 2014 Act, there will be no right of appeal for these people against a revocation decision, or a curtailment decision, unless the Secretary of State considers a Human Right claim and certify it as unfounded, then there will be an out of country appeal.

If the Article 8 claim is founded, then there will be an in country appeal.
