Wife and Son extension application

Post by JAYSON65 » Sun Jan 17, 2016 10:38 pm

Hi, I am a British citizen and my wife and son are about to complete their first 2.5 years visa on a 5 year route in April, 2016.

My wife got her visa on FLR(M) and son his as a dependant on the first 2.5years visa.

Now, I know my wife would submit for the further 2.5years on FLR(M) in April,2016 and my son should apply I guess on FLR(FP).

He turns 21 years in May 2016 and in his 2year in university studying civil engineering and is applying separately now as an adult.(got first 2.5years when he was 18years old).

Both wife and son came in to UK in 2007, and are due for ILR in 2017 on a 10 year route basis.

QUESTIONS:
1. Are the right forms FLR(M) and FLR(FP) for wife and sons further applications to complete 5 year routes in April 2016?
2. Once they attain 10 years in 2017, which forms are needed for ILR applications?, SET(M) and SET(O)? respectively?
3.Also, can they both apply for ILR once the 10 years is completed before completion of their last 5 year visa route ( which should be till 2018?)
4.Having been here for more than 7 years before applying for their ILR can they apply straight for citizenship after ILR approval rather than wait for another 1 year?

Thanks for your advice(seniors comments very welcome).

Regards.

3. Once they reach 10 years residence, they can apply individually for ILR based on long residence.

4. Your wife can apply immediately for BC once she gets ILR as you are BC and she does not have to wait 12 months on ILR. Your son will have to wait the full 12 months on ILR before he will qualify for BC, there is no discretion in this for a person over 18 not married to a BC.

1. Include son in wife's FLR(M).
2. SET(LR).

Is it ok to include son in wifes FLRM and submit together as one application for both?

He is 21 in May this year.

Thanks.

If he was previously included in your wife's first FLR(M), then it's okay to continue to include him.

My wife has masters in Marketing from UK in 2012 and son did his A levels in UK and in 2nd year in university here too in UK studying civil engineering.

Do they need to take English tests to submit their applications for the 2.5years remaining on FLRM application (5year route)?
Both have passed their LIUK tests already.

Thanks for your comments.

Wife No, she can use her degree.

Son, yes. A levels are not accepted to meet the English language requirement. He needs to do the A1 test from one of the HO approved test providers.

LIUK is NOT required for FLR(M) extensions. It is ONLY required for ILR.

There doesn't appear to be any English language requirements for son, included in FLR(M), under R-LTRC. However, for ILR, he does need to meet the KOLL requirements, under A280(b), 299 or 276B.

Even if the son is over 18?

The English language requirement appears to be only applicable to partners. I don't see any mention of it under R-LTRC.

I have checked the rules but cannot see where son needs to attach English cert, is it ok to submit application for both on FLRM(same application on one form) with wife masters degree only?

Regards.

Paying for my son and wife health surcharge of £500 each soon, do I pay this separately online or the whole £1000 on my wifes account as she is the main applicant on their FLRM application?.

Application goes together on my wifes FLRM application for both son and wife.

Advice on this please?
