Tier 2 General to Tier2 General switching employer

Post by Azbill666 » Sun Jan 31, 2016 9:53 pm

Hi
My tier 2 general extension is in process with UKVI and delayed due to exceptionally complex issues stated by UKVI on 4rth Dec 2015.
During my application process time I have applied for new job and interviewed, got the job but with different SOC code in same field.
New company is aware of RLMT and they have proper separate firm who looks after there immigration matters specially Tier 2.
New employer is not aware of my complex letter by UKVI, initially I showed them biometric letter only.
I have applied with 3 dependents.
My Questions:
Once new company is done with there HR formalities and give me Cos, what can i do if
1- my application is not decided until then.
Should I withdraw and apply with new cos. ( any application fee would be refunded or no chance)
2- if my current application refused due to any reason, can i apply fresh application with new cos in 28 days or 60 day's.
3- what should be the best option i go for ?
Personally I wAnt to join new Job even i pay new fee.... But i am confused with All circumstances due to long delay.
I have spent 3 years on tier 2 general.
8 months left in 10 years long residency.
Please Help

Make sure your new sponsor conducts the full and proper RLMT process otherwise your visa will be refused.

1. You wait till your application is decided. If withdrawn or refused, you lose the fee. The visa fee has to be paid for each application you make and you have to pay the immigration health surcharge.

2. Yes, you can apply again, but depends on the reason for refusal.

3. Would it not be better to wait the 8 months with your current employer and then apply for your Long Residence ILR?
Once new company is done with there HR formalities and give me Cos, what can i do if

Hi CR001
Thanks alot for response and guidance which we always seek from you
And I apologies for PM
I can wait 8 months but only thing is new job is better opportunity and much better salary, with very good company profile.
Obviously all depends on my current application outcome.
Incase of rejection or fresh application, hopefully I don't need to pay Health surcharge again.?

You need to pay immigration health surcharge with each application you make.

hi
i have little confusion for Vary the application;
in specified forms and procedures; it says
"A person who varies their application does not have to pay an additional fee unless the new ground they want to be considered under has a higher fee than their original application. In this case, they must pay the difference between the original fee and the new higher fee."
"This means a valid variation will look like a new application. You must check CID to see if an earlier application exists which does not yet have an outcome. This will tell you whether the new application is a variation of an existing application which has not yet been decided."

do i come under this statement, how can I check CID ? what it is ?
can you please guide, which form do i need to fill? if i fill online form or is there any downloadable form.
please help and guide.

CID is the Home Office in country data base system used to manage casework. You do not have access to it. The information you are referring to is the caseworker guidance, hence the instruction to look at CID.

Which forms to complete.... Someone else will have to answer that one, sorry.

See page 57 in the link below about varying an application. Not sure what you want to apply for so can't really say what form you need.

Upage 57 says
A person who varies their application does not have to pay an additional fee unless the new ground they want to be considered under has a higher fee than their original application. In this case, they must pay the difference between the original fee and the new higher fee.

So i dont need to pay fee or i will pay and get refund for in process application if it is not been decided before they receive the new application recieved by caseworker.

If incase my new application get refuses and i get 28 days to do or new application, in that case what will be my status, would i be legally allowed to continue working for my existing employer? If yes
For how long ? Until my another new application is in process. ?
Thanks
