Granted Less Leave than applied (Tier 2)

Post by jia_khan » Wed Dec 30, 2015 10:44 am

I applied for Tier 2 visa for 3 years with one dependent. The CoS is 3 years long and job type is permanent. We have been granted leave for 2 years 14 days with an IHS refund without stating a reason. Does anyone know on what grounds they can grant less leave than applied?

Are you currently on a Tier 2 and would your combined leave total more than 6 years?

Are you sure that your Certificate of Sponsorship was assigned for more than this?

I switched from Tier 4 to Tier 2. Yes my CoS is exactly three years long. I have a copy of CoS. I have applied for Administrative review also. Let's see. I am just wondering if this is a mistake?

Hi,

We are in the same situation. Our applications have been approved and got the BRPs on 27th Jan 2016. The issue date 24/01/2016 and valid until date was 08/01/2018 but we applied 3 years from 26/12/2015 to 25/12/2018 and no refund of immigration health charge.

Did you hear back from home office about your administrative review, if yes, can you please share your experience.

Thanks,
Thiru

Hi Thiru,

We received a letter yesterday that our Administrative Review has been successful. They asked us to send Biometric cards back so that they can issue new cards. I hope this helped.

Hi,

Can you please tell us how long the administrative review took for you?.

It says normally it takes about 28 days to process the administrative review.

Thanks,
Thiru

Hi Jia Khan,

Did you get your new BRP cards with correct leave?.

Did you apply for administrative review (£80) or Did you send an email to admin.review.enquiries@homeoffice.gsi.gov.uk?

Its been just over two weeks i did not hear anything back from HO. I understand it took you 28 days.

Thanks,
Thiru

I applied for admin review. After exact 28 calendar days, I received a letter that the admin review has been successful and I should send BRPs back. I posted BRPs and after 5 working days I received new BRPs with corrected leave to remain. And 80 pounds were refunded.
