My dates are in my signaturefarrukh786786 wrote:@2011marryam sister many many prayers for u may Allah give u success and home office should learn a lesson to not breach family rights if an innocent kid is involved.
How many month u had waited for ur court date as I noticed cases involve with kids usually receive court date earlier unless case would be much complicated.
That is very sad to hear and there are so many more who are unnecessarily in the same situation.stillwaiting123 wrote:@binubinu
Don't worry sis inshallah it will all work out
My hubby has not seen my 2 year old for 9 months now and this upsets me more than anything, inshallah our sabr will be rewarded x
I am just assuming that's what happens, right? If they haven't reviewed till the deadline then it will automatically go to a hearing.farrukh786786 wrote:Dont loose heart sister , you will win at review stage in sha Allah .A mp from labour !! Really strange behaviour .Anyway why u r thinking that if u wont listen till ur deadline its goes to court , undoubtedly tribunal listed it for court but u will still have chance to win it until bhc upheld their original decision so my suggestion is just wait a couple of week and at 15 feb do send an email to ur mp that still bhc didnt review it in this case atleaset he would be able to make ur case reviewed postive or negative .May Allah make it podsitive for u and all of us.Good luck we all pray for u .may Allah reunite an innocent soul with his love ones.

Firstly so sorry about your refusal ino how down and upset u may be feeling at the moment but dont worry everything happens for a reason....Heena0524 wrote:Hey everyone it's my first time on this, a bit of help would be greatly appreciated. So let me start, previously my husband was a overstayer his visa expired in 2009 the same year I met him. We got engaged in 2011, we put up a case of human rights in 2012 and it got rejected we then continued on to religious marriage (nikkah) in 2013. We was mislead by our solicitor at the time. Then we had a court hearing, and the judge felt we had a genuine relationship but he went on to say that I did not meet the financial requirements so the case got refused. Between all of this my husband got detained for 15 days. Last year, we thought that it was better for him to go back voluntarily, in order for me to apply for spousal visa,so that I could meet all the financial requirements so that he could return smoothly. In order for me to meet the requirement of earning and accommodation I worked 2 jobs. I applied for the spouse visa in November and it got refused yesterday. What I would like to ask is upon the refusal of my case the reasons given by the person who assessed my case was:
1) relationship not genuine
2) the second job I only obtained to meet the requirement
3) my husband when he got detained was accused of giving false identity (when he sat down in the station he gave his own name and details, but gave other information at the scene because he was in a vehicle who belonged to a friend)
4) they accused my husband for working without permission as they "saw" on his bank statements. However, his bank statements only show money coming in from myself and other family moments to support him as he was not working at the time.
The question I have is the options given by my solicitor is to appeal or to prepare for a review to take place of my case, my question is which one of this would you suggest and why?
Thank you,
Heena

Looks like u have had a very long journey so far i hope everything is sorted quickly
Id like to just explain to u that "review" and "appeal" is one thing first it goes to a review which is a 15 week deadline in which the eco has the chance to change their mind, once deadline is up then u have to wait for a court hearing all this is a very lengthy process many of us have been waiting 4/5 months after our reviews being declined for court dates.
In your case i would say go for the appeal as they will keep refusing u if u apply again and u need to get your point across to them in court, i am 99% sure u won't get the visa at review stage as u have many strong refusal points.
Once u get a court date u should be able to explain all the situation to them regarding your husband and hopefully this will clear things up. On the point of your job id say keep the 2nd job going as if u leave it their point is then valid.
I really hope things work out for u sis
Goodluck x

Firstly, thank you for your quick response.
I would like to add that I have valid reasons and evidences against the points that they have claimed, wouldn't this make a difference?
stillwaiting123 wrote:@heena0524
Yes unfortunately sometimes they dont list all the refusal points and then use them when u apply again
Id say appeal 100% as a new case would be a total waste of time and money for you, then c how review goes, if successful your sorted.
If not then explain all this in court it just all looks like a mix up to be honest
When your husband was detained was he married to u?

Yes sis he was married to me, so are you saying go for the review? Or just the appeal?
If I just go for appeal how long would it take?
Thank you sis for thisstillwaiting123 wrote:Heena0524 wrote:stillwaiting123 wrote:@heena0524

Ok i dont know if it will make a difference that he was married to u then or not
And like i said review and appeal is a whole process u can't go to appeal (which is court) until a review has happened
U can c my timeline below
I appealed may 2015
Got my review deadline for 27th October
On 22nd September i called the tribunal and they said it was unsuccessful at review and was listed for court
Im currently still waiting for a court date if not ill be reapplying in April
U need to send the appeal off and get a oral hearing (court) this cost £140
Then after about 5/6 weeks u will get a notice stating that u have a 15 week deadline (3.5 months)
Then if they change their minds at review u should know within 5/6 weeks of the set deadline if not then after the 15 weeks are up its 100% going to court.
Court dates can take long anything from 1-12 months to be honest currently the waiting time is 6/7 months
Some people's deadlines were July/August and they are still waiting for a court hearing
