EC rejected - mistake by British Consulate

EC rejected - mistake by British Consulate

Question on behalf of my sister, a US passport-holder.

She was approved for HSMP on 5 June.

She applied for EC from the NYC British Consulate on 12 November.

Yesterday, she received a letter from the consulate saying that her application was rejected because it missed the six-month deadline of 5 November.

This was a mistake. 5 November was her FIVE-month deadline.

However, now her true six-month deadline has passed (it was on 5 December).

What should she do? Should she send everything back to the consulate hoping that she will gain entry clearance?

She needs to go to embassy and talk to the PR officer about the case.

Do you have a xerox of approval letter ?

Take that and the EC rejection letter while going. I think the BHC/embassy should allow this since it is their mistake.

Why did'nt you people appeal immediately for such a small mistake !

Now I believe the 28 days of appeal have also passed.

If not, then appeal immediately.
But before doing that, try to go the NYC British High Commission and ask to re-consider as this is a silly mistake.

Thanks both for the advice.

My sister just received the rejection letter on the 6th, the day after her six-month window passed. She literally couldn't have appealed within the window; it was impossible.

She has all of the original documentation, including the approval letter which reads "you have six months from 6 June 2007 to apply for entry clearance."

I guess what we'll do is go back to the embassy ASAP and ask them to reconsider. Finger crossed, it shouldn't be a problem if we get it in soon.
