1) HSMP applied in 2005 and got approval letter in 2005.
2) HSMP Visa was granted in Sept 2009.
3) First extension was done in Sept 2011. As per HSMP rules there is no financial requirement, only thing was he need to show economically active. But by mistakenly he showed around 25K as self employment.
4) After couple of months, he realised that it was not required. So he declared HMRC 7K and no tax paid.
5) He was in employment during second extension, So it was extended under Tier 1 GENERAL category.
6) His current visa was valid till mid of 2017
NOW we have below questions.
1) Under which category he need to apply for ILR ? either HSMP or Tier 1.
2) Is there any problem for his ILR application, Because of he showed different figures to HomeOffice and HMRC during first extension under HSMP ?
3) If he adjust the pending tax to HMRC now, Is it ok for him to apply ILR. What is your best suggestion.
