Requirements for time between PR(EEA) and Naturalization?

Hi guys,

Thanks first of all the help I get from this forum.

Does anybody know if there is any requirement before applying for naturalization after obtaining the PR as an EEA national? Apart from the fact that I should not leave the UK for more than 90 days. What I basically what to ask is, would I have to exercise treaty rights during this period of 1 year? i.e. to be full employed, to be a student with insurance etc etc? or are the treaty rights irrelevant now?

Yes.

Citizenship rules have noting to do with the EEA Regulations. They have their own separate and unrelated requirements, one of which is to have settled status. In your case, it means PR. Provided you have PR, EEA Regulations are irrelevant for the purposes of naturalisation.

Maintain your 'good character'.
Check nothing in your record over past 10 years (both in UK & abroad) to cause 'good character'-related issues.

Make sure all other requirements for privilege of citizenship have been/can be met;
- including proof of physical presence in UK 5 years before date of application for citizenship.

Make sure absences over past 5 years (at time you apply) have been within limits.

As mentioned above don't forget you now need to submit a PR card for naturalisation (not simply have acquired & hold PR).

Secret.Simon, it makes sense what you are saying. I had the same thing on my mind, but I couldn't find that anywhere written down formally. Do you maybe have a link of a goverment's website, where I can find what you are saying? I mean not in the exactly same words, but roughly...

Noajthan, yes you are right about the good character clause. The only penalty I had, was a tube ticket, which I think should be fine :) I don't understand quite your last paragraph about the PR card. Could you please explain this further?

To apply for naturalisation you now need to hold a PR card to confirm you have acquired PR.
Before this year it was not necessary to submit such a card when naturalising.

If you already have your PR card then all good.
if not you will need to apply for one.

Nojathan, aaaaaah now I understand what you mean. Yes I am aware of that, I do already hold a PR(EEA) card because of that reason. In last November they made it compulsory to hold a PR card.

In terms of treaty rights, do you agree with what Simon says above that I don't need to prove that I am exercising treaty rights now because I am considered to have settled in the UK by holding a PR(EEA) card?

Yes, that is also my understanding as having PR means you are settled already; the advice from secret.simon is spot on.
