ILR Refused Please help

Hi,

My ILR has been refused in a premium service application. The basis of refusal was that the SOC code given had a "new entrant" and "experienced" payscale. While I was eligible for the new entrant, I was £1000 short on the experienced. I am shifting from a 5 year Tier 2 visa to ILR after working 5 years for a company so they said you are automatically counted as experienced and you are being underpaid, hence your application is declined.

I just want to know, if I get my company to increase my salary, is one month payslip with increased salary enough for re-application? Or do I have to wait for more time? Actually I am getting married in 2 months so I really want the ILR asap. I would be grateful for any help.

Thanks for the reply. I went through the link you sent me and I was unable to locate the specific words where it confirms that. Please be advised that I am Tier 2 General and not intra company transfer or any of the other categories. Sorry for bothering you repeatedly with the same question but I dont want to lose another £1900.

245HH Specified documents

The specified documents referred to in paragraphs 245HF(h) and 245GF(d) are set out in A, B and C below:

A. Either a payslip and a personal bank or building society statement, or a payslip and a building society pass book.

(a) Payslips must be:
(i) the applicant’s most recent payslip,
(ii) dated no earlier than one calendar month before the date of the application, and
(iii) either:
(1) an original payslip,
(2) on company-headed paper, or
(3) accompanied by a letter from the applicant’s Sponsor, on company headed paper and signed by a senior official, confirming the payslip is authentic.

Thanks. As I said, my confusion arose from the fact that these are the documents required to prove that you are an employee that is being paid. If they see the payslips before the "raised income", they may say that I need to have had the raise for 3 or more months before I can claim that I fit the required criteria. Thanks again.

u just need a months payslip with the pay rise and the same reflecting in ur bank statement.

Income Calculations

Hi,

I have failed my ILR application on the basis that my income was insufficient. My company has been nice enough to raise the income. I am just having issues understanding how they calculate the annual income. UKVI has asked me to have £27,200 based on a 37 hour week and I work a 40 hour week. Could someone please calculate and tell me what should be my annual salary and/or per hour pay? I would be grateful.

Hi

if you do 40 hr a week for 27200 ur pay will be less on prorating the salary.
its 27200/40*37.5 = 25500 which will be lower than the threshold for ur ilr.

u need to lower ur hours to be able to succeed in ur application.

I understand that I do a 40 hour week but instead of reducing my week, I am trying to calculate how much I need to be paid for 40 hours to satisfy the £27,200 per 37 hour bracket.

U need 29405 for 40 hrs to meet the requirement

ILR Re-Application

Hi All,

I am reapplying for an ILR application refused on the grounds of insufficient income. My company raised my income last month and I am applying on that basis. I just wanted to re-confirm that one month of raised income is enough for re-application. I have the payslip and bank statement detailing my raised income for one month only. Please note that all my payslips before Jan show the paid amount with insufficient income so I will attach my 5 P60 forms from 2010 to 2015 and 1 month payslip and 1 month bank statement. Would that suffice? Sorry for bothering you all over this but I just dont want to waste another £1900 and just scared if it fails again.
