Hello Noajthan,
Subsequent to your advice on my other post could you please advise on this...thanks
Hello respected moderators and gurus, My brother is currently on a short stay visitors visa(6 months) and seek to apply for an EEA-FM as the spouse of a Dutch national.
1. will a marriage by proxy where the EEA sponsor is present/double proxy suffice?
2. can the non-EEA national return to the uk with his soon-to-be wife (Dutch national)on his multiple visitors visa( 2 months left to expire) after his marriage outside the uk?
Thanking you in advance in anticipation of your contributions.

1. will a marriage by proxy where the EEA sponsor is present/double proxy suffice? No. What nationality does your brother hold?
2. can the non-EEA national return to the uk with his soon-to-be wife (Dutch national)on his multiple visitors visa( 2 months left to expire) after his marriage outside the uk? After the wedding he should apply for an EEA Family Permit from outside of the UK as he would no longer be entering as a genuine visitor.
Thanking you in advance in anticipation of your contributions.
Bear in mind that the UKVI will want to see strong evidence of a genuine relationship.

Please don't send me PMs asking for immigration advice on posts that are on the open forum. If I haven't responded there, it's because I don't have the answer. I'm a moderator, not a legal professional.

Thanks Casa for your response.

Ans: He's Ghanaian.
b]Bear in mind that the UKVI will want to see strong evidence of a genuine relationship.
Ans: Thanks. They have proof of communication going back one year and they will have a genuine ordinance marriage at the registry.
Can he not return on his visitors visa for their honeymoon as it'll be still valid instead of applying for the EEA-FP?
