EU1 urgent query HELP???

So after waiting 7 months when my temp stamp expiring in 4days i got an email from INIS saying its gonna take more 5 to 6weeks before a decision is issued.That is just so wrong and unacceptable.Dont know what to say to them anymore.its so frustrating.Can somebody please guide me through this best possible way.i will appreciate it thanks

Inform them that there actions are clearly unlawful, that there is no basis for the delay and that legal actions will be sought if the unlawful act us not brought to an end.

Thanks for your reply obie,

This is what they replied today after 7 months & considering my visa expires on 21st Feb 2016,

"Your application was received in this o­ffice on 22/07/2015.

Applications are processed in chronolog­ical order. Due to the large volume of applications on hand, it may take a ­further 5 - 6 weeks before a response is issued from this office. On­ce your documents have been processed, they will be returned to you­ and any outstanding documents will
be requested.."

They kept emailing me saying decision will be issue shortly but now what they doing is absolutely awful.What can i reply back to that so they can make a decision asap?

Are you represented by a solicitor ?

If you are, then they should be able to write them to get it sorted.

Yes i do have a soliciotor but they are useless they dont answer my calls or emails been there few times extremely poor communication and unprofessional.

Shall i write to the department of justice or just email them?and what do you reckon i should say to speed up the process?

you waited for 7 month better to wait for another 4/5 weeks....by sending them email or taking any other legal action will take more then that time any way.....


you are lucky at least they bother to send you email....i know lot of ppl who are just know nothing about their application.

I think the best thing is to just wait and tolerate, its not just you there are many others waiting from months, the onus is on the department of justice to send you the final decision. Hopefully you will get your decision in the coming 2 weeks.

Griffith you received your letter recently didnt you? How long did they take? And if my temporary stamp expires what will happen? Do i need to get an extention or shall i just wait?

Yes you are right , my temporary visa expired on the 10th January and i got my final 5 years approval letter on 21 January which means within 2 weeks after my visa expired, and during that time period i just emailed them once and they replied that it will take three weeks but the decision came within 2 weeks.
If i were you i wouldnt send them any email threatning the department of justice as it may worsen the scenario, personally i know alot of people waiting from months for temporary stamp, just wait you will get your letter very soon.

I have been sending them emails constantly through out the process and they kept saying decision will be issue shortly but i think you are right i guess im gonna have to wait for few weeks and hope its positive outcome. Thanks for your help

HI,
I am going through the same story, my temp stamp 4 will expire 22/02/2016
they just send me same email saying that it may take a further 6-8 weeks before a decision
is issued from this office.

is it OK to stay even after the temp stamp 4 expire?

Dont mind me asking when did you apply and i think we are gonna be okey as our application is still in process but im not 100% sure. It is rediculous though that they need more than 7months to process an application. Anyways We cant do anything apart from wait and hope they make a decision soon

Dont worry danny the only thing we can do is to wait.. My decision date was 17th january and till the date i havent recieved my decision. And i emailed them to ask status of my application then they said your application is in the queue to be processed . This unit will be in touch with you shortly. So we can only wait

I understand we cant do much. I last emailed them yesterday that what they doing is unlawful and unacceptable. I have contacted the solvit as well coz i beleive if i dont take any further actions they might delay our decision longer. My visa expires in 2days then i wont be able to keep my job. Has your visa expied?

I think its gonna be a long wait mate coz they dont seem too bothered with our applications but lets hope its a positive outcome

Hi Danny65,
Good Morning!

Were you or your non-EEA dependant given a 6 month stamp 4 after INIS received your application? If they were given a stamp 4 and if 6 months have passed your application processing timeframe then, you should be escalating this issue to SOLVIT.

As per the EU/ EC guidelines the host state should not take more 6 months to process an application for residency. Within these 6 months the host state must either refuse or approve the respective application.
Should they not adhere to the norms then the applicant has the right to escalate the matter to "solvit" for undue delay.

Yes i was given 6 months temporary stamp which expires on this sunday. I would not have a legal status in the state after that and most likely gonna loose my job. I have been sending them emails couple days before my decision was due. They kept saying i have up to 21st feb letter will be issued before thay but now they sent me email stating its gonna take more 5,6 weeks. Thats just not acceptable.
I have emailed solvit explaining my situation. Lets see what happens now. They say they are dealing with applications chronological order but i know few people who got their letter in due time and they applied after me so they just mislead people but i hope at the end its positive outcome.

Second weeks coming to an end since my temp stamp expired but still havnt heard back from them. Its frustrating that they couldn't make a decision in almost 8months now and i provided them with all the relative documents when i submitted my application.
