My situation is that I am an Irish Citizen who has been living in the UK
off and on for 8 years, permanently since the start of 2006. My wife is
from Thailand, she has been living with me here in the UK since 2005.
She came here with work permit and we eventually got her a
resident card based on a family member of an EEA national.

I am a DIY guy and got her the resident card with out any help from
anyone. It can be done but the Home Office did everything to drag out
the process to the last minute and fought me every way possible by
requesting items that were not required in the application initally.
When I provided what was asked in a very timely fashion at the
last minute, her passport was lost somewhere at the home office
followed by mine. Very silly tactics or plain stupidity perhaps both!

I never gave up. I called up several times sometimes a day sometimes
hourly asking to talk to supervisors. I threatened with lawsuits and
taking the issue directly to my MP. I made it clear that my annual
leave was coming up shortly and I had tickets booked for our family to
go on a world wide tour and will demand compensation. Eventually they
blocked out my mobile number from going through to them.
I showed them they would not get rid of me until they did their job.

They finally gave in and we able to get her passport back with her new
resident card. The day before our holiday, she had to drag a baby all
the way across the UK to Croyden and back to sit in a queue all day.

I believe this was my punishment for not paying for the 500 GBP
expedited fee. In aggravation and phone expenses, I paid more much than that!


What I want to do is obtain a UK citizenship for her and myself. We
have a child born in England who is a UK citizen and every time I want
to take my family with me on a trip, we have to go and get my wife a
visa because she is Thai.

I am not sure that she qualifies yet.

When did she come to the UK on the work permit, and when did she switch status?

Hello Victoria,

She entered the UK May 2005 and her status was changed in Nov 06.

I know there is a wait period and heard different time lengths from different people.

Then I don't think she can get Permanent Residency until 2011.

What about the OP's wife switching to spousal visa (If allowed under the current rules) using the UK Immigration Route and obtain a 2-year visa. At the end of the 2 year visa, apply for ILR and then citizenship. Or can she use the Ppron Method?

She can leave the UK and apply to re-enter under the UK rules, and be eligible for ILR after two years.

Yes, I am sure she could use the ppron method.

Regarding British citizenship for you, the first question is that when you say you were living in the U.K. "on and off" how much time exactly were you spending in Britain since about late 2002?

Also, how did you get your Irish citizenship? Born there, naturalised, etc?

I aquired my Irish citizenship through a previous marriage. I could have gone the route of obtaining it through a grandparent born in the ROI. I did spend one whole year 1999-2000 finishing a professional qualification in the UK. From 2000 to Mid 2005, I speant probably about 30 days a year in the UK. In mid 2005, I was sent over by an American company for a six month assignment and met my present wife and never really left the UK for a long period of time since.

What kind of things does the home office want to see to prove how much time I have speant here?
