Hi,

I am very much confused and scared after working hard and making money for myself and Inland revenue

I came here on HSMP in sept 04 worked till nove 05 in london and my ist years income for 6 months was 8000

then i got a contract job from British agency to work for a british company in Dubai and i was paid in London in my barclay a/c my income for second year was 44 000, i worked for this british agency till june 2007 and my third year income was 110 000 , and for part of 4 th year was for ist qtr was 21000

after my contract was over i came back and now my earnings are around 3000 pm

i visited london for 4 days one time and 5 days another time in this 18 months contract job

I have all documents from my employer about requirement of working abroad at client facility with bank statements, p60, tax assessment and pay slips
i have some concern about absence, will this affect my counting for ILR


I have paid around 45 000 NI AND TAX in period when i was working in Dubai

Please advice

You say you paid UK Taxes for your stint in Dubai. Please confirm
You say you worked most of your time in Dubai and returned to the UK minimally. Please calculate your absences for this period.
Did you continue to pay rent in the UK and can you show your payments?

Initally it was a contract of 12 week work and one week paid leave with air ticket to UK and all cost paid (GBP 30 PER HOUR )

After that it was again extended for 13 week and this way i got total 6 contracts from Local recruitment agency , I was on their pay roll , weekly salary was paid in my London Barclay accounts after payment of NI AND TAXES

I was staying as paying guest in my first year in london and all my salary slips and bank account statement, my mobile phone bills my wife's bank a/c statement I received at my london address from my home owner.

rent payment will difficult to show but all my mobiles bills , and other communication i can show

Were you sent on this contract by your then UK employer or was it a case of accepting a contract via an agency on your own volition?

Why don't you answer the questions asked?

I'll have a go, but it's largely going to be guesswork.

I think you came to UK on HSMP, Sept 2004 and left November 2005 on an IT contract in Dubai via you own limited company based in UK for 18 months, thereby resetting your ILR clock.

You are somehow hoping that as your limited is a UK one your absences won't count.

I am a finance person and the company is not my company it is addeco a leading high street recruiter agent , i worked on their pay roll.

OK, but crucially, did you leave your initial UK/HSMP employ to work via Addeco?

Immediate before this contract i worked for a stock broking company for one month before that I taught in 5 different colleges to ACCA students on hourly basis and worked part time in accounting firm in london

these all aove employer have no connection with Addeco and its clients

In that case I think your ILR clock was reset and restarted when you returned to reside in the UK.

If you'd been sent abroad by ur UK employer you could argue the case but it seems you effectively negated ur HSMP when u took employment out of UK for that period.

See waht others think tho...
