Folks if my wife is a Germany exercising her EEA treaty rights and am African after 5 years...which forms should I apply EEA3 or EEA4???? Thanks

She would use EEA3 and you would use EEA4. Bear in mind both of these forms have now been superceded by EEA(PR) and although you are still allowed to use the old forms, they are not easy to find on the gov.uk website.

Again especially the EEA4 forms are hard to find and I don't know why?however I have found a site which generate EEA4 forms can I still use that???? The EEA4 forms seem simpler ....and I think I made a mistake by filling the EEA3 form but they didn't tell me it was wrong form..they refused my application based on the fact that I did not give them an Evidence of my Sponsor Treat Rights prior to 2012.

The EEA2, EEA3 and EEA4 forms have all been combined in a new form called EEA(PR). This is the one that UKVI prefers people to use now, but it is 85 pages long and quite complex if you're not completely sure what you are doing. It also asks for a lot more information than you are actually required to give.

However, they cannot reject an application which is made on an old form. In fact, you are not required to use a form at all, you can simply write a letter, as long as you supply the necessary information and payment.

thanks Ohara...by the way I have now got the EEA4 forms so I need to fill that or just write a letter with the reference of the refusal case and attach the evidence they need??

bcos the refusal sent letter sent to was attach with " I can appeal in tribunal" of which some good friends told me I should forget the Tribunal and reapply with new evidence they want...

please I need advice....Thanks

If you messed the application up the first time, it would probably easier just to reapply. Remember you will need to pay the £65 fee again.

Make sure you supply all of the required supporting evidence and documents!

do you mean I should use EEA3 form again since I use it for the first one????

What about if I use the EEA 4 form and explain to them I made a mistake to the EEA3 form but now am using the EEA4 form then make reference to the former case with the new evidence???

Use the EEA4 form as that is the correct one for your situation.

what about, my EEA sponsor was a student from 2009 to 2011 would she be affected by the CSI???

Yes, as has been mentioned several times if you read back through the above posts.

Proof of CSI or alternative (or exemption) is required for qualified persons who are/were students.

My concern is, she was in vocational training as (Beauty therapy) NVQ started 2009 to 2011, but if you read the CSI conditions it stated that from 7/2010 -2015....

Please I need direction, because reading the instructions it looks as if the
Sponsor and the Non-EEA family member can fill one EEA(PR) form...but am not clear if some one can help me ...thank you
