ILR(PR) with 3.5 months gap - What are the chances?

ILR(PR) with 3.5 months gap - What are the chances?

Hi All,

I will be completing 5 years in June 2008.
However I had a gap of 3.5 months in that 5 years periods.
As per ILR rule, there should not be gap of more than 3 months.
If there is more than 3 months gap then the decision is at the discretion of the officer.
It will not be possible to get any letters from the employer or any letters to justify this gap.
The gap was due to change of employment and processing of new WP.

Does anyone know what are chances the chances of getting ILR with 3.5 months gap?

Any input/advice will be highly appreciated.

Actually that 3 months gap which was stated is not the gap in employment, But the period over which we were not in UK

If you wre jobless for 3.5 months and stayed within UK then no problem at all (And offcourse Visa periods should be continous without any break)

Or if you are outside UK for more than 3 months then if you can proove that you are ouside UK officially sent by employer then also no problem. But for that letter from employer is must

If you are unofficially outside UK for more than 3 months then as per rules they may / may not approve PR. But dont worry. You have just spent 1/2 month extra outside UK. If you get a Kind caseworker he may approve your PR.. it really depends on caseworker now

Even in very worst case no need to worry, you can extend your workpermit and apply for PR once when 5 years is completed from the date of that break
