My husbands visa was refused on and i appealed, i received the notice of pending appeal on 28th january 2016 with a deadline for 12 may 2016. Unfortunately no updates can be provided until then which is very annoying, i make lots of duaa that the decision is overturned and does not goto court. My question is after the 12 may if the decision has not been overturned can i contact the courts to ask whats happening? Also will this be thw first month for when they list the name for a court hearing or will these five months be included?
Applied : 5th august 2015
Refused: 7th december 2015
Appealed: 28 december 2015
Deadline: 12 may 2016
Overturned: 2nd august
Passport submitted: 11th august
Still waiting...

Sorry to hear of refusal, you need to be patient, inshallah your decision will be overturned, what were your reasons for refusal? If the decision is upheld at review stage your court hearing date will around a year from there on!!

I worry about the bundle because i think he might include some new evidence and if i am going to send my bundle to court without viewing them i will be in trouble Allah forbid

Do you mean a year on from may or from the date the appeal was submitted?

There were two reasons for refusal:
1) they said the name on my husbands passport did not match the name on the english certificate although there was only one letter mistake which i asked the centre to rectify however they refused. With the appeal i sent a copy of the email city and guilds sent to me admiting thwir mistake as well as all the information husbands test number name, photo etc.

2) employer did not pay my tax therefore it showed i was unemployed for a month however this was a mistake from the employers side, employers letter has also been provided stating i as an employee was not aware of any changes made to the company therefore this was a mistake from their side.

Refused: 7th december 2015
Appealed: 28 december 2015

Around a year from May, it might be worth reapplying with all documents and priority service, take around 6 weeks for decision.

Did your wage slips match the amount paid into your bank? Did you provide 6 months payslips?

Yes i provided 6 months payslips payslips and they matched the amount paid into my account

So wat u mean that the rule is change nw cuz i pass city and guilds A1 which is valid fr 2 years bt nw u r sayin that u need to pass ielts A1..

Yeah the city and guilds is no longer acceptable

Oh ALLAH :( frm which date this new test rule starts..? I got ma refusal on 19th Nov 2015 Bt they refused me by nt submitting appendix 2 form i mean only one point thy accept ma city and guilds A1 test..Plz lemme know the date..?

Yeah they accepted it for all applications until 5th November any applications after that u cant use it
My hubby did the test and we used it for February 2015 but now we plan to reapply in april he will have to do the ielts life skills a1

My appeal was allowed on 4th Sep 2015 received letter on 2nd Nov 2015 to submit passport which I did since then no response I even complain to Home office on there email id no response from them either anyone can advice mewhat can I do ????

I think it can take maximum 12 weeks?

I know its 90 days 4 weeks for judge to send the decision and 8 weeks for Home office to process unfortunately when I contact HO they are like I am sorry you have continue on waiting made complaint still no response even sent 2letters they not bother to reply.........

Hi All,

My wife spouse visa refused on following grounds.

1. Appendix 2 form not submitted so Eco decides marriage is not genuine
2. I submitted my part time pay slip along with sa302 form from my self employment. my self employed declared income was more than the requirement but HO called me and dig into my employment in details.

I would like to ask is it better to go for appeal or to make fresh application and if fresh application should I just ignore my employment or I will have to address that as well in my new application. I am expecting to re apply by next month as my wife need to give new English test.

Hope to hear some informative feedback.
