I am really confused about my situation and am i hoping knowledgeable people in this area would help me out.I have been coming to the Uk since 2000 when i met my husband to be,in 2004,i came on a visit with a tourist visa in september,we got married in december but my visa expired in december that same year.I stayed in till the end of january 2005 because of issues related to my husbands vaccinations and went back to my country with my husband.We got a spouse visa for 2 years and returned to the Uk on the 20th of march 2005 and i got an indefinate leave to remain this year in february.I want to apply for naturalisation and i am confused because i have been told since i am married to a British citizen the qualifying period is 3 years and i qualify now because i was in the UK in 2004,does the period between december ending and January when i overstayed affect me or do i have to wait for february to satisfy 3 years from 2005 when i got the spousal visa?Thank you

See also BN7 - Naturalisation as a British citizen (B. Requirements for a person applying as the husband, wife or civil partner of a British citizen, 7e) also Chapter 18: Naturalisation at discretion, Annex B: The residence requirements ( paragraph 8 ).

It may be best to apply from 20th March 2008.

Look at these for the vague refusal of citizenship with paragraph 3(d) being cited. Case workers at the Home Office have recently said they have no idea what paragraph 3(d) is to my wife who passed all checks and has P60's for well over 5 years:

You have not been granted indefinite leave to remain on or permanent residence in the United Kingdom, you do not meet the requirement at paragraph 3(d) of the leaflet. The application is therefore refused.
