Student to HSMP dependant

Hi,
My spouse is currently in UK under student visa which is valid till Jan 2009. I am going to apply for HSMP.
What process should I follow for applying for a HSMP dependant status for my spouse as both of us are in UK?
Can I do it when my spouse is incountry or will he have to go back to the home country before he can apply for hsmp dependant?
