How long does it take for a judgement to be read out?

I cannot remember feeling so anxious, apart from waiting for my exam results when I was younger.

WHILE we wait.. I wonder if anyone cares to guess what happens to those who are on the cusp of qualifying under the new, iniquitous 5-year rule (20 Jan 2008 in my case)? just getting ILR a week or 2 early does nothing for us. UNLESS of course rolling back to 4 years for those like us would mean that one can apply for citizenship as though one had ILR for a year already....

any guesses?

"We regret to inform you that the Indefinite Leave to Remain 4 to 5 years (ILR 4-to-5) Judicial Review that took place on 17-18 November 2007 was unsuccessful.
The judgement was fully in favour of the Home Office. There is however an intention to appeal"

this comes right when i was planning to move on...now i got my hopes high AGAIN.

this will be the best xmas present.8)

:cry: I am amazed: mostly at my own credulity, for thinking that British sense of fair play was real and not just a motheaten cliche. I first came here to study in 1970 and I swear there was still something of it left then.

what happened? can one blame New Labour, or the EU?

We won't know until we get the full decision disclosed, but we blame the government in the first instance, and then probably the judges.

The 4-5 could have been won IF only there were some really good cases of people suffering hardships or people were denied / lost their opportunity to apply for ILR because of the 1yr increase and till date I have not come across any such case posted on any of the forums.

Yes, but the government does not exist or operate in a vacuum. there is an environment/zeitgeist that would allow such blatant unfairness to pass unchallenged except by those it hurts.

I jokingly suggested the EU is to blame, but I am not sure that is totally wrong. It was absurd not to expect the hundreds of thousands of Poles and other semi-skilled migrants; but neither the government nor the people were prepared for the onslaught.

Seven years ago I came to the UK. It was a random decision. I don't know why I chose it over other English speaking countries, such as the US, Canada or Australia.

Over the years, I have come to realise that was one of the worse decision that I have made in my life, a complete mistake.

Just when I was ready to settle down and have a home here, Britain has the worst house price bubble in the whole Western world. I struggled, big time, to own a tiny pad, when what I pay could have bought me a mansion in Canada or Australia.

Now another slap in the face by the government, for THEIR complete failure to control illegal immigrants, and have my life encumbered by a long wait. If I had gone to Canada or Australia, I would have gained full citizenship by now. Here I am, after all these years, still holding a temporary visa.

I sometimes am asked for advice from people back home on going abroad. I have been telling everyone, don't come to the UK. It is one of the most difficult places to settle down in the West, it has one of the lowest quality of life in the West, and it is not a welcoming country.

There are plenty of cases, not least of all the people who came on the old, old HSMP scheme and found thet come the end of their fourth year not only did they no longer qualify for ILR but no longer qualified for HSMP because of the removal of the exeptional/significant achievement points. We have at least one family on our files, and I know another who returned home last year.

I wonder if they just didn't like that it was the equivalent to a group action and it was too far reaching. Perhaps the only way to fight it is on a case by case basis which isn't really fair either.
