Ahmd_64 wrote:Hi Guys,
I am on Entrepreneur Visa of £50K route. I have an employee who is working 25 hours a week from 18 months. I an confused about hours. Will 25 hours be considered part time equal to 15 hours per week or 25 hours? I thought if one employee does 100 hours a month and he will cover 3000 hours in two and half years and remaing hours i will hire another employee for 15 hours per week for last year.
Is my calculation right or 25 hours will be considered part time employee of 15 hours?
Please give me solid feedback according to the Appendix A.
Regards.
You are wrong. Transitional arrangements cover only those who entered the route before April 2014 and so it doesn't apply to you as you entered the route in June 2014. The guide is very clear on this. The date you applied is irrelevant.Ahmd_64 wrote:I applied visa July 2013 and got visa in June 2014 when HO withdraw from Appeal. I think i am in old policy that one employe can cover two jobs if he work two year as a full time. Let me correct if i am wrong please.
No they won't. That is only allowed under transitional arrangements. Even under such arrangement, a part time worker who worked for two years is counted as one year full time job only because any total time over 30 hours a week is ignored.Ahmd_64 wrote:So they will not consider 3000 hours of 2 and half years as a full time employee? You must create two full time roles/jobs for 12 months each. Part time hours can be added to reach 30 hours a week ONLY if the part time jobs lasted for at least 12 months. Extra hours over 30 a week are also ignored.
Paying wages via cash will not be a problem if you are reporting PAYE appropriately to HMRC.Mahir1108 wrote:A quick question in this thread.
If I payed an employee by cash(all tax + NI declared to HMRC). Will it be a problem during extension.

Please read Appendix A table 5 or 6. It says those who apply before April 2014 they will not be supposed to have 2 full time or 4 part times employees separate.
I am in pre April 2014 policy when one employee can cover two full time employees job if he work full time for two years. Please read appendix A. This will clear you. My question is about total number of hours and calculation. My employee has done 1854 hours in 18/19 months. How many hours will be considered? Has he completed one full time job after doing 1854 hours in 18/19 months as a 24.5 or 25/week.

You didn't even create a single full time job based on what you said.
