PR for family member of qualifying EEA national person

Hello.

My husband and I we are both from EU, he already has document certifying permanent residence. Can I apply as a family member? Or it's only for non-eu members?

As an EU citizen, have you resided in the UK for 5 years?

yes, I'm.
but my 5 years continuous employment will be only in September 2016. (don't want to wait till that time).

This does not appear to be a stupid question.

Yes, you can acquire PR as a family member via your sponsor.
That would mean your activity in UK is immaterial (although hopefully legal ofcourse).

When is the latest of your 5th wedding anniversary and the 5th anniversary of living in UK with your (current) husband?
You may have acquired PR by then.

Have you had any prolonged absences from UK during that period? how about spouse/sponsor?

Our 5th wedding anniversary will be in June 2016. And 5th anniversary of living here together was last year in October.

We have only about 30 days absence from the uk during all these 5 years...

It seems you could acquire PR in June then. That is after 5 years residence in UK whilst married to your spouse/sponsor.

Yes in effect. It takes 5 years to acquire PR.
As a direct family member you need to be married to your spouse/sponsor.

So that means married for 5 years and residing (as a married person) in UK for 5 years too.
You can do the maths for your timeline.
