Previous Earnings for ILR (Via Tier 1 General)

Hello all

I am in the process of applying for ILR.
I have a query in relation to 'previous earnings'. I have to show earnings of £35000. I am going to show earnings from the duration of March 2015 to March 2016.

My previous employers paid me on the 20th of every month for the service from 1st to the end of every month.
I also undertook a project for a non-UK based company from May 2015 to Feb 2016. For the project which ended in February 2016, I received the final payment on 4th March 2016.
Can I show the earnings from 20th March 2015 to 19th March 2016 (I WANT to show the payment on 4 February 2016) or do we have to take the service period into account as well? If thats the case then I will need a letter from the company abroad confirming that they made a delayed payment....?

Please someone clarify. Thank you for your time and consideration.

Are you applying for ILR by end of March 2016 or early April 2016?
If Yes,
May be you can consider claiming income from April 2015 - March 2016. That will take care of the issue.

Hi

I am applying on 31st March.
I want to show the payment I received on 20th March 2015 as I received a bonus that month. And I wanto include the payment I received on 4th March 2016. Thats the issue

You can use either march 15 or march 16. It would be march 15 to feb 16 or April 15 to march 16. Home office counts your payment the month it comes into your bank account not the month you invoiced your clinte.

Please confirm are you saying that HO counts the transaction dates rather than the service date?
Can I not show from 19th March 2015 to 18th March 2016? (This will include both the transactions I want)

They Only Consider Transaction Date's, ( Basically Money Earned in 12 Month Period )

Applying for ILR next week. Do they ask clarification about the earnings that we don't declare too?
I changed 4 jobs and since I don't want to complicate more, I am only showing 3 as it fulfills the earnings requirement.

Please someone clarify

As far as your earnings are above the required threshold (enough to get you the required points), you don't need to disclose the entire earnings.

Please correct me if I am wrong :)

HMRC earnings and Tax paid will be higher than earnings disclosed to UKVI. It would be a problem if vice versa is the case i.e. OP disclosed higher income to UKVI and lesser to HMRC, thus indicating a tax fraud.

But for instance a person's annual income for 12 months is £100,000. He only needs to show £ 75,000 to score required points. In this case if he disclosed only 10 months salary, wouldn't that be ok. He doesn't necessarily have to show full 12 months salary ...... right?
Now HMRC will have full 12 month salary while UKVI will have 10 month salary ..... Correct?

Please correct me if my understanding is wrong. I am in learning stage and trying to help, so I wont mind at all :).

Sorry for my earlier advice. If I were you, I would go with Casa's advice. better disclose entire earnings rather than risk having questions from case workers.

Hi Casa and R

I applied for ILR on 31 March and successfully acquired it. Now awaiting permit card.

Let me explain the case:
My intention was not to hide anything from HMRC or UKVI. As R mentioned since the earnings was simply more than minimum required, I did not want to complicate. The tax paid by the employers wouldn't be any more or less... It would be exactly what is supposed to be. Had they cross-checked, everything would match.

In case had they queried, my answer would have been the same "to keep it simple and not make it complex".. But thankfully it didn't come to it.
Just to mention, I submitted all bank statements which clearly also showed the earnings in reference.. May be that made it clear to them that I wasn't withholding anything.
Nevertheless this forum had helped me always. So thanks for everything.
