Each entry on the visa is limited to six months. Has the leave for her most recent entry expired?
Should she be refused a residence card, I strongly suspect the visa will be cancelled, for the Home Office is unlikely to believe that she would intend to return after any subsequent entries to the UK. It might very well be cancelled regardless.
I believe they are retaining the passport so as to make it easier to administratively remove her if they refuse the residence card. This may be unlawful if assurances in Parliament have any influence in court - Vivienne's solicitor is treating it as such according to
her topic in this forum.

Thank you, no her last entry was three month ago and she has not breached the 6 month rule in the past. We wanted her to leave the country now and come back in 1 month so that there is no breach whilst she is waiting for the RC application. Given she has never breached immigration laws why would they believe she is not going to leave if the application is refused? Do you know if this May have any impact on the outcome of the RC application? Thank you!

Hi All,
I had applied EEA2 on January/2016 and all done biometric/COA/passport return.
Now i got my passport back from HO and enclosed letter says if i want to travel outside to UK i need to apply EEA family permit to re-enter UK( it is something like as i did for first time coming) I can declare more strong documents like proof of living here in UK me and wife's wageslip, lots of proof of address etc..
Does everybody receive same letter says need to get EEA to re-enter?
What about to try COA for boarding from abroad? i know it is hard and risky but heard some people done it.
I have a schengen as well which would help me maybe get to France or Belgium than much easy to reach UK border with COA and no visa..
Higly appreciated for your comments in advanced.

Finally, my documents arrived yesterday along with a letter confirming that my parents are getting a biometric card in the next 10 working days. I am so trilled. Cant wait for RC's now. It has been a long 2.5-3 years journey.

We are in the same situation. Applied for EEA UK RC on 23/02/2016 and have not received any letters yet.
Can only assume there is a big back log of applications at the EEA HO Centre in Durham.
Now things have happened FAST.
Got the Biometrics request on 17/3/2016 - Completed on 18/3/2016
and RECEIVED the CoA today 24/3/2016 with right to work.
So sometimes the HO works quickly.

Abs566 I was wondering whether your second document request form was sent on the 08/03/2016 as I know you mentioned in your previous post that it had been over 20 working days?
I withdrew my EEA2 application on the 9th of March 2016 as I did not submit my passport or original marriage certificate in the first application and I reapplied on the 14th of March with a new fresh application and all the correct documents. My payment has gone off my account for the new application (on the 18th of March).
I am however still waiting for my withdrawal request package to come back. After 10 days I submitted the second form. I don't know why it takes so long to send back a withdrawal request?

@ kunfayakun. I am british and my parents are non EEA.
@candy1 I have no idea why home office takes so long to return documents. Keep chasing them up ring them every other day. you might get through to someone who is ready to help you and put an internal request for documents to be chased. Only in that case you will get a call back from HO to verify whether documents have left or are being processed.

Does HO always call the sponsor's employer ? I was wondering if they are more likely to call for unmarried couples.

Based on personal experience i would recommend you set up a redirection service with the royal mail after notifying the HO of your address change.

After 5.5 months, RC arrived today. We were married (EEA and non EEA) in non EEA home country 4 years ago. We hadn't officially lived together in the same address all that time, but we provided a lot of picture evidence that we had been together travelling and staying with relatives. No employer call or interview or anything. I think we were pretty straight forward. I entered on a 6-month visitor visa. RC arrived via post not courier, no other documents have been returned yet.
14/10/2015 Mailed Package EEA-QP and EEA-FM
15/10/2015 Package Signed for
19/10/2015 Payment taken
26/10/2015 Email received for EEA QP
28/10/2015 Biometrics mail received/biometrics completed same day
20/11/2015 COA/w work
01/04/2016 RC arrived via post, dated 25/03/2016

I was confused as I read the following paragraph in the EEA FM form
Family members included in your application
You can include your family members on this application form if they also wish to be considered for a registration certificate or residence card. They must be related to you or your sponsor in one of the ways set out on page 1.
Please note: you must pay an additional £65 for each family member included in this application. If the fee does not cover you and your family members, the application will be rejected and returned to you without consideration.

If your daughter is an EEA citizen, as I expect she is, you don't need to get a
registration certificate for her. You can just fill out the form for yourself and pay one lot of £65 + £19.20. It makes sense to include multiple family members on the same form, as there would normally otherwise be a lot of duplication.

Hi sorry in advance I am new here if I do mistake please forgive me.
First of all about me I am non EEA applied ROR June 2015 my app was not straight cause my ex wasn't cooperative so i go through solicitor and send documents marriage certificate and divorce cert and her employer detail cause they refused to give letter to me and my daughter birth certificate. In few days they send my file back written that money doesn't gone through and we sent it back in July 2015 and money gone through in august 2015 sent bio matric same in august and they send me COA With right to work in September 2015 dated 10 September 2015 and then I didn't hear any thing from them till February 2016 so I insist to my solicitor to send them letter and he did and we did not receive there reply and then I insist again to my solicitor to give them call so he call H O on 23rd of March and operator said your caseworker will give you call back in 5 days but we didn't hear any thing yet I am really confused please any one can suggest me any thing. Thank you in advance and again sorry if I made any mistake here

i have been reading comments and messages in thread quietly, this thread helped me a lot with my EEA application was keep coming back everyday for new updates specially timeline for EEA app.

FInally received my RC 26 March 16 Dated - Received on 03 april 16
here is my timeline
03 oct 15 applied - next day app received
12 oct 15 - bio letter and COD both received together with no right to work.
29 - oct 15 bio given
26 March 16 RC DATED - received on 03 april 16
there was simple and plain envelope my RC was Inside no recorded delivery postman just dropped in letter box.(WTF)
No interview No phone call , No questions been asked during my app.
GOOD luck Rest of Guys waiting for RC
