If you don't mind then please precisely correct my understanding that what you meant that they blames you for self employment and employment at one time when you were student? And did you mention such self employment in employment history section for the time you were student??

Sorry for your refusal :( did you mean your appeal was refused by court so they considered that you were overstayer? Thought you were fine if your was under appeal or of you left before chance to submit an appeal was over.

Did you still manage to get your ILR?

i was registered selfemployement during psw visa just to switch to tier 1 general hsmp. now they checked my selfemployement taxes are uptodate??? then they asked hmrc about my all selfemployement and employement history which led to disclose on them about my full time work during student time too.

As i mentioned earlier i wrote all 10 year history during student i was only emoloyed.

hello mate sorry to hear about your refusal. could u please eleborate a bit more about your history from 2008 to now. if you could start like that it would helpful for us to understand bit more and see where we stand.
like for example:
WHEN you were on student visa and when on psw etc
sometime like this
2008-11 type of visa ?
2011-2016 - type of visa?
which years you worked full time while you were student?
and if theres any ban for you to apply for naturalisation in future or not?

It seems like he got his ILR on 10 years basis in Dec.2014. He applied Tier1 in 2013 which was refused and he spent rest of the time on appeals. His all appeals exausted e.g July 2014. He remained 2 months as over stayer and applied ILR in August 2014 and got ILR in December 2014.
His application was already complicated due to his over stay period as HO is very strict on this nowadays. Secondly, his all previous appeals were refused and that was another issue. Thirdly, he did not get his Tier1 Visa so technically from 2013 he was on any Visa or maybe on 3C.
Also as he mentioned earlier he used to do Two jobs and that can be very easily checked when you get BR code. Which definitely indicates someone working more than 20 hours.
But i think there is more into it if he explains us when he entered in to uk. I believe he came in 2004 because he got ILR on 10 years in 2014.
I wonder what was his status between 2004 to 2008.
Also if he has written Two Job working at the same time in 2008 to 2011. In that case HO does not need to verify as he himself declared he worked 2 jobs when he was student.

I entered uk 2004 august as student then switch to psw 2011 then 2013 I applied for hsmp.
yes I worked full time from 2008 -2011

from 2008 - june 2010 worked full time ---- visa status student

then I got psw then continue working with same employers

but when I contacted hmrc today on 29th march they said home office inquired about me and asked for 10 year tax and NI contributions including selfemployement tax records.

Did you write in the employment history section that you worked for two employers between 2008 -2011?
Secondly what documents did you provide related to self employment with the application?

I agree with fielddrive & zzzindagi perceptions that declaring 2 jobs in one time during student time then the payment of high taxes flag up the case to be checked from hmrc and self employment further complicated that matter. Otherwise 10 years long residents usually had spent student time and in 99% cases they worked full time which was allowed until 2009 especially when student in summer break, waiting next semester and earlier completion of studies. And 2ndly hmrc never keep data or don't want to know the working hours. In my point of view self declaring 2 jobs in student time along with higher payment of taxes on those 2 jobs and self employment issues are responsible otherwise number of working hours can never be known as the hmrc don't have such information.

Approval as of today is the 4 month mark from when I sent my application via Canada Post to the Home Office!!!! I was disappointed when I checked my mailbox this afternoon and all that I received was some junk mail. This makes my day!!! Can't wait for the ceremony in just over a month!!!! :D :D :D
