Assuming you are in the UK and your original leave already expired you can make a fresh application with a new unrestricted CoS within 28 days of the AR decision but you are not allowed to work until the fresh application is granted.
Any stay beyond the expiry of leave is an overstay (illegal stay). Overstay of 28 days or less is "ignored" - this doesn't mean that the overstay is "legal".
1. No permission to stay means no permission to work.
