income for HSMP extension?

Hi all,

I'm currently on HSMP that expires in July 2009. I'm studying part-time as well as working. I am intending to apply for pupillage in barristers' chambers to start in September 2009, but I am wondering if the income from the pupillage "draw down", i.e. when chambers give you an advance on the pupillage income to fund you in the year before you arrive at their chambers, would be counted as income for the purposes of HSMP extension - given that barristers' chambers are technically not companies and are composed of self-employed people. I am not sure if they even give people payslips for pupillage.

The issue is that I need to remain at the points threshold for income in the 12 months preceding my renewal application, which would be the period June 2008 to June 2009. A pupillage draw down could increase my income points dramatically. So can I count this as earned income? I have heard mixed reports about this kind of income, i.e. some say the pupillage income is an "award", i.e. non-taxable, and others say it's salary.

If they don't give out payslips and advance the money, could one count that as self-employed income or income as an independent contractor?

I would very much appreciate clarification on this from any lawyers out there, or indeed anyone else who can help - many thanks!

I wouldn't rely on this income. it is like counting your chickens.
Further it is meant for a period not within the period in questions.
Finally, you need to focus on the basis of why you got hsmp and it wasn't for studying so stop setting yourself up.
