FLR(M)Various Questions

Post by jagatex » Fri Apr 08, 2016 5:05 pm

Hi

I'm about to pay for my wifes flr (m) his surgarge online. I have registered and have got to a stage where it asks about dependents.

Sorry if this sounds dumb but our child is british through birth. Am I right in thinking that I don't have to include the child in the dependent section??

I ask this question because I'm worried I might get stung like I have previously. An immigration advisor claimed I could claim working families tax credit/child tax credit because I was british. And aslong as I didn't get a penny for my wife it was ok. On the eve of applying I have been told that due to the large amount of savings I should not have applied for working families tax credit!!

The ironic thing is the 2 schools of thought are from advisors who work in the same organisation!! :!:

No dependents to be listed for IHS if not applying with your spouse.

Also, don't put your information in, your spouse must 'apply alone'.

WTC does not take your capital into account, (just any interest earned on them over £300.) Unless that capital is treated as income that can be taxed:

"However, in some cases where the Income Tax rules treat capital as income,
and tax it as such, you will be expected to include the taxable amount as
income in your tax credits claim. This can happen if, for example, you
hold shares in a UK company and the company gives you a stock dividend
(new shares) instead of a cash dividend."

https://www.gov.uk/government/uploads/s ... _02_16.pdf pg 24

From what you have said you seem entitled to claim it.

You need to complete the form with your wife's details only. You and your child are British and don't have to pay the surcharge.

Your wife is the applicant, she must proceed for IHS payment in her name not yours.

Hilarious, I can picture it. 'Hi Applicant, I am home. What's for dinner?'

Yes, you can pay with your card, no problem.

Is this too little, Ive read that you don't want to go crazy and write an essay.
I 'm wondering if something like this will do.
How much old ground do you have to cover (From stuff you already mentioned in the initial spouse visa?? :?: )

What home office speak to they like that I can put in at the bottom. Somethimng like I fulfil the criteria set out by such ... 7 such immigration rule section...sub section.

You don't need a detailed cover letter. The application form covers what HO needs plus the supporting documents.

Flr (m)

I'm looking at the application form for an extension and need clarification on a few issues!

(History-- My wifes spouse visa is going to expire on the 23rd of april)

Section 2 category of application

2.2 ask...,

first period of eave to remain(following an initial period of entry clearance as a partner of a settled person, or following an initial period of entry clearance as a finance or proposed civil partner of a settled person- 6 months.

Second period of leave to remain (following initial grant of leave to remain).

Now I would think ticking the second option is correct, but the first option has some truth in it ie the underlined bit.

YOU CAN SEE WHY IM A LITTLE CONFUSED!!

Anyway for those appling for an extension on the initial spouse visa I presume the seond option is the one to tick.
