Tier 2 General Visa Extension

Hi,

I received Tier 2 Employer sponsored visa in Jan 2013. I was made redundant in Dec 2013, We received cooling off period from UKBA till May 2014 to look for a new sponsor. I got a new sponsor within that period and applied for Tier 2 General visa. My Tier 2 Visa for new employer receive till end of June 2017. I have 7 months gap to complete 5 Year wok permit. Please let me know if it possible to go for Extension in June 2017. As I will be eligible for ILR in Jan 2018.

Are we eligible to apply for ILR Straight away without extension or Is it required to go for extension and then apply ILR.

You will need to apply for an extension.

You cannot apply for ILR if you do not have 5 years minus 28 days residence. 7 month gap is too big.

Hi Thanks for your quick reply. as per my understating 5 years minus 28 days residence means is that i can apply for ILR before 28 days of completing 5 years work permit. Please correct me if I wrong.

Hi,

My wife is Tier 2 dependent visa. she is pregnant right now. if baby born in UK, I assuming baby is not UK citizen until we are in ILR. My Question is:

1. If baby born in UK do i need a visa for baby Right to live.
2. If i have extension in June 2017. do i need to apply visa for baby as well.
3. If my wife stayed out side UK due to her pregnancy more than 6 months will it be a problem when she applied for ILR in Jan 2018.

1. No, but visa will be required if traveling.

2. No, not if there is no plan to travel.

3. No, as long as you can prove subsisting marriage and frequent contact etc.

Thank you so much for your prompt reply.
1. If Baby born in UK do i need to pay NHS health surcharges.
2.If Baby born outside UK my wife will she be eligible for maternity paid leave.
3. As mentioned earlier i was made redundant by previous employer, iIhaven't had a job nearly 5 months , Home office gave 60 days curtailment leave, i got a job with in 60 days and aswell as new sponsor tier 2 General visa. My 5 months unemployment gap will it be a problem when applying for ILR. Is this 5 months gap will be included in 5 years work permit.
