Post by utk » Tue Apr 12, 2016 12:41 pm

Hi All
Im new to this post & need your help & advise
I applied for UK Tier 2 visa which was refused in Feb 2016. I went for Admin Review & they sent me an email after 30 days & asked me to submit my passport.I submitted my passport very nest day i.e. 05/04/2016
NOw I received another email from NewDelhi.VisaEvidentialFlexibilityReply@fco.gov.uk as below

This refers to our email of 5/4/16 to you wherein you were requested to submit your and your dependants passports to the Visa Application Centre at which your application was originally lodged. Please ignore this email as it was sent out in error. We apologise for the in convenience caused. We are returning the passports (3) to the visa application Centre (VFS). Kindly collect the same from there.

What does it mean? Im very stressed. Please suggest what is happening.

did u had to pay for AR? If yes, and if it is paid by card, generally the indication that AR has been succesfful is that you get the payment back. If it not accepted and they are still not giving you the visa, then the money is not returned.
By the face of it, it seems that they had sent an email in error and hence the visa is not granted. (this is just understanding from reading the email)

Thanks Iworker

No I did not pay for admin review as they mentioned that it is free of cost.
I did not understand that why they sent an email to ask me to submit the passports after 30 days of admin review. How this can be an error as they mentioned in the email that....

05/04/2016
The Entry Clearance Manager has reviewed your application and you are requested to submit you and your dependants passports to the Visa Application Centre at which your application was originally lodged.

& on 11/04/2016

from the emails it seems as if it was a mistake and AR has not been successful. I think they will give a letter as well explaining why AR was not successful.

why was the visa and subsequent ar rejected?
the best they can do is follow the rules properly and give you a cos..
all tier visas are point based visas. If all rules are followed, visas are almost always granted. there is something wrong on your or your employer part that it is rejected.

Hi
They rejected the Visa application saying that they have a doubt that my employer performed an ILMT properly although my employer claims that they have everything mentioned int he rule book & have the valid COS, Dont know why they are not satisfied.

Regarding AR rejection I did not receive any letter or email from them yet so dont know what is the reason but they sent couple of emails, IN first email they asked me to submit the passports which i did.

In second email they said that the email was sent in error & i can collect my passports from VFS

Not sure what is happening.

have u confirmed and checked if all the things stipulated in the requirements of rlmt were performed. If the client did it, they would like to think they did it correctly.. but maybe a third person should glance over it to confirm where they have gone wrong.
moving forward, i think first check where did they go wrong, do rlmt again, issue new cos, u apply new visa. this is only option for u moving ahead.

The UKVI would have substantiated the refusal reason with an explanation of why they think the RLMT process was not followed leading to doubt. They would also point to the grounds for refusal. You would have got these in your refusal letter. If you want an opinion on next steps, you would need to post them here. The likelihood is your employer would need to rectify these , conduct RLMT again and issue you a new CoS for your to reapply.

Hi All
I received another email today (Not sure if this is scam or they really want me to pay extra IHS) stating.....

"A change has been made to the details you provided. You need to pay an additional healthcare payment of Rs 63,000.
What you need to do next
You will have received an automated e-mail from the Immigration Health Surcharge portal containing a link that will allow you to pay the required top up amount. This payment must be made by 24/04/16. (7 WORKING DAYS)"

PLEASE SUGGEST WHAT IS IT? IS IT A SCAM

Apologies but how can anyone spot a scam from an email paste! You should ask your prospective employer to check the status of your CoS in the SMS. They should also have a way to contact UKVI. Its much better than you contacting UKVI. BTW you didn't cite the refusal letter wording!

@iworker- But don't you think an employer sponsoring a candidate has interest/responsibility after having conducted RLMT and offering a CoS, to ensure the visa process is smooth/successful. At the end of the day, they have invested in the candidate and my own experience is that an employer would have an immigration specialist/outsourced solicitor to help with this. This may not be true for all employers though.

Hi All
I spoke to British embassy & they said it is legitimate email so I paid the IHS again i.e. INR 63000
Lets wait for the final outcome. This is refundable in case they dont approve the visa

Hi All
Any reply on this please. How long will they take to decide now as it has been 46 days since I have applied for AR. They asked me to pay IHS is it a good sign.

There is no relation between your IHS fee and National Insurance number. You should request one as soon as you land in the UK. You can call HMRC and request one over phone to receive a number in post.

You might find HMRC don't issue National Insurance Numbers..... DWP do though and they won't send you one in the post after a phone call either.
You will have to apply, complete a form, provide identification and a proof of your right to work in the UK before a NINO is issued....

I stand corrected. It is indeed the Department of Work and Pensions, that issues National Insurance Number. You will have to call their NIN application line, explain your need for NIN post which the application and further process will follow. You can however start work without an NIN by telling your employer that you have requested one and supplying it when you receive it.
