Hi All,
As I have mentioned in my previous post my tier 1 entrepreneur extension application was refused. I have applied for Admin Review but have not received any reply yet since last 26 days. How long does an AR decision normally take?

So you applied after your tier 1 entrepreneur expired? So you were overstayer at that time when it was refused?
So how come you managed to apply for another extension having overstayed for more than 28 days?

Hello OHMV, and Seniors,

What could have happened if it was refused again on 17th Dec 2015 as it says above in OP?

He would go for AR but would he be able to submit another fresh application after 2nd AR refusal?

I just want to understand options available.

As the original application was made after the expiry of the visa, how come the second application did not fall for automatic refusal?
Very confusing as the caseworkers' guide seems to suggest that you are overstayer even if you apply within 28 days.

28 days since you first AR was concluded. You cannot apply after that or in case of a second refusal

But in this case, Ohm was already an overstayed when he applier the first time. So how come his application was accepted after overstay of more than 28 days?

As far as I can see, if someone applies the first time after the expiry date of their visa, they will not get a 2nd chance. There will be no section 3C to extend your leave while the application is in process to begin with

Yes, so I'm surprised that Ohm got to apply again. It's great that he got the option but looks like caseworker misunderstood the guidance.
