Following amendments to the Nationality Act 1981, children born in the UK only qualify for registration as British Citizens if one of the parents is present and settled in the UK ( i.e. British national or having ILR). The OP would be able to add the child on his visa as a dependent and apply for registration as soon as he is granted ILR in 5 years time. If, on the other hand, the child is born outside the UK but joins the OP later on as a dependent, he/she would qualify for ILR along with her parents and would be able to apply for naturalisation a year later..Anthopogon wrote:Hi CD,

You hv two choices.
1. Take your wife w you and send her back with new children to India with his/her British Passport(if I am not mistaken, there is a legal provision citizen by birth, pls check British Citizenship Rule to cnfm). Perhaps your wife needs you at her critical period(emotional suggestion)
2. Wait till your child birth and apply EC for both of them.

Secondly, the VFS officials have an incentive for every rejected application as it means more money (in second application fee) for VFS. Looks like its a very well planned strategy on part of VFS.
