Child benefit after separation from partner with ilr

Post by jiajiabb » Mon Apr 18, 2016 10:47 pm

Recently separated from my ex-partner who had indefinite leave to remain. He applied child benefit for our son (British citizen now). I have leave to remain as spouse at the moment. I have just applied to switch over to leave to remain under private life.

Child benefit has been paid into his bank account so far and I have never seen that money. Since we separated, he lost his job and has not seen our child or paid any maintenance for our son. Does he still qualify for child benefit? Can I apply to have child benefit transferred to my account? Will that cause me any immigration issue in the future (will qualify for ilr through 10 years in 2017), since I'm currently under leave to remain upon private life? If so, does it mean the parent that has nothing to do with the child receives child benefit, while the parent that actually looks after the child does not?

Thank you all for any advise you could offer me.

Were you subjected to any domestic abuse in the relationship?

You should infirm HMRC he is no longer responsible for the child.

You should request access to public funds if you are granted leave with no access - https://www.gov.uk/government/uploads/s ... NRPF10.pdf

For the interim period, social services have a legal duty to provide resources for the welfare of children. Contact them and they should help.
