Tier 2 general ILR

Post by arti999 » Mon Apr 18, 2016 11:04 pm

Hi Experts,

I am going to apply ILR on june 16 ( 5 years route). I been working under same employer since 2011, recently i had noticed my tax for first year was not filed by employer...not really sure on this and i am making this assumption for worst case. How will this impact my application

Any reply will be highly appreciated

Thanks,
Arti

And how exactly have you 'noticed' that your first year tax wasn't paid or filed?

Ask for a tax history for your paye from hmrc. Hopefully since you are working for the same employer, it shouldnt be too much of a problem. They can always be asked to pay it. Did u receive salary in bank?

It's a legal requirement to issue payslips.

I would suggest the following:
1. Speak to HR/finance team of your employer. It is almost impossible that they did not generate a pay slip. Possibility is that it did not reach you or you misplaced. See if they can give a duplicate playslip/form 60
2. Call HMRC, they are very good. First to ask the details on the phone so that you are informed and know whether the tax is paid or not. Post that ask them to send you last 5 years details. Understand what is wrong/right and then decide what you need to do

IMHO

Cheers,
Jacob

Hi Arti,

Can you update what happened during your ILR application? I am also in the same boat. My P60 had wrong NI for year1. I was issued the correct p60 now but as per my ex employer it will take few months to reflect the change.

Did you get asked for p60 by the case worked ? I am eligible to apply in Aug but looks like I need to push it back

Please do let me know if they asked for P60 or 5 years history

Thanks
Neha
